| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Title 3, Parks and Wildlife Code, is amended by |
|---|
| 11 | 11 | | adding Chapter 21-A to read as follows: |
|---|
| 12 | 12 | | CHAPTER 21-A. CENTENNIAL PARKS CONSERVATION FUND |
|---|
| 13 | 13 | | Sec. 21-A.001. DEFINITION. In this chapter, "fund" means |
|---|
| 14 | 14 | | the centennial parks conservation fund established under Section |
|---|
| 15 | 15 | | 49-e-1, Article III, Texas Constitution. |
|---|
| 16 | 16 | | Sec. 21-A.002. USE OF CENTENNIAL PARKS CONSERVATION FUND. |
|---|
| 17 | 17 | | Money in the fund may be spent only to: |
|---|
| 18 | 18 | | (1) acquire state park sites from the United States or |
|---|
| 19 | 19 | | any of its agencies, agencies of the state, or any other person; |
|---|
| 20 | 20 | | (2) improve, develop, beautify, equip, and maintain |
|---|
| 21 | 21 | | park sites; |
|---|
| 22 | 22 | | (3) provide grants to political subdivisions for local |
|---|
| 23 | 23 | | parks as provided by Chapter 24; and |
|---|
| 24 | 24 | | (4) support department land, soil, and water |
|---|
| 25 | 25 | | conservation efforts. |

| 26 | 26 | | SECTION 2. This Act takes effect January 1, 2024, but only |
|---|
| 27 | 27 | | if the constitutional amendment proposed by the 88th Legislature, |
|---|
| 28 | 28 | | Regular Session, 2023, providing for the creation of the centennial |
|---|
| 29 | 29 | | parks conservation fund to be administered by the Parks and |
|---|
| 30 | 30 | | Wildlife Department is approved by the voters. If that amendment is |
|---|
| 31 | 31 | | not approved by the voters, this Act has no effect. |
