| 7 | 7 | | relating to fire protection sprinkler system requirements for |

| 8 | 8 | | certain residential buildings by municipalities, counties, and |
|---|
| 9 | 9 | | emergency services districts. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 250.011(a), Local Government Code, as |
|---|
| 12 | 12 | | added by Chapter 315 (H.B. 738), Acts of the 87th Legislature, |
|---|
| 13 | 13 | | Regular Session, 2021, is amended to read as follows: |
|---|
| 14 | 14 | | (a) Notwithstanding any other law and except as provided by |
|---|
| 15 | 15 | | Subsection (c), a municipality, county, or emergency services |
|---|
| 16 | 16 | | district may not enact an ordinance, bylaw, order, building code, |
|---|
| 17 | 17 | | or rule that in any manner requires or conditions, directly or |
|---|
| 18 | 18 | | indirectly, any regulatory approval on [requiring] the |
|---|
| 19 | 19 | | installation of a multipurpose residential fire protection |
|---|
| 20 | 20 | | sprinkler system or any other fire protection sprinkler system in a |
|---|
| 21 | 21 | | new or existing one- or two-family dwelling. |

| 22 | 22 | | SECTION 2. The amendment by this Act of Section 250.011, |
|---|
| 23 | 23 | | Local Government Code, is intended to clarify rather than change |
|---|
| 24 | 24 | | existing law. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2023. |
