55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to fire protection sprinkler system requirements for
88 certain residential buildings by municipalities, counties, and
99 emergency services districts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 250.011(a), Local Government Code, as
1212 added by Chapter 315 (H.B. 738), Acts of the 87th Legislature,
1313 Regular Session, 2021, is amended to read as follows:
1414 (a) Notwithstanding any other law and except as provided by
1515 Subsection (c), a municipality, county, or emergency services
1616 district may not enact an ordinance, bylaw, order, building code,
1717 or rule that in any manner requires or conditions, directly or
1818 indirectly, any regulatory approval on [requiring] the
1919 installation of a multipurpose residential fire protection
2020 sprinkler system or any other fire protection sprinkler system in a
2121 new or existing one- or two-family dwelling.
2222 SECTION 2. The amendment by this Act of Section 250.011,
2323 Local Government Code, is intended to clarify rather than change
2424 existing law.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2023.
