| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter P, Chapter 201, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Sections 201.9955 and 201.9956 to read as |
|---|
| 12 | 12 | | follows: |

| 13 | 13 | | Sec. 201.9955. PROGRAM CATEGORY FOR PROJECTS RELATED TO |
|---|
| 14 | 14 | | BORDER SECURITY. (a) The commission by rule shall include in the |
|---|
| 15 | 15 | | project categories established under Section 201.995(a) a category |
|---|
| 16 | 16 | | for projects related to improving border security and establishing |
|---|
| 17 | 17 | | international trade corridors. |
|---|
| 18 | 18 | | (b) The projects assigned to this category must: |
|---|
| 19 | 19 | | (1) provide greater security in the movement of goods |
|---|
| 20 | 20 | | or enhance the flow of goods from an international border crossing |
|---|
| 21 | 21 | | onto the state highway system; or |
|---|
| 22 | 22 | | (2) mitigate congestion affecting airports, railroad |
|---|
| 23 | 23 | | crossings, or other transportation infrastructure located within |
|---|
| 24 | 24 | | 60 miles of an international border crossing. |

| 25 | 25 | | Sec. 201.9956. FUNDING FOR PROGRAM CATEGORIES CREATED BY |
|---|
| 26 | 26 | | LAW. A category required by law to be included in the categories |
|---|
| 27 | 27 | | established under Section 201.995(a) may only be initially |
|---|
| 28 | 28 | | implemented if the legislature makes a specific appropriation for |
|---|
| 29 | 29 | | the purpose of implementing the category. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2023. |
