99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter P, Chapter 201, Transportation Code,
1111 is amended by adding Sections 201.9955 and 201.9956 to read as
1212 follows:
1313 Sec. 201.9955. PROGRAM CATEGORY FOR PROJECTS RELATED TO
1414 BORDER SECURITY. (a) The commission by rule shall include in the
1515 project categories established under Section 201.995(a) a category
1616 for projects related to improving border security and establishing
1717 international trade corridors.
1818 (b) The projects assigned to this category must:
1919 (1) provide greater security in the movement of goods
2020 or enhance the flow of goods from an international border crossing
2121 onto the state highway system; or
2222 (2) mitigate congestion affecting airports, railroad
2323 crossings, or other transportation infrastructure located within
2424 60 miles of an international border crossing.
2525 Sec. 201.9956. FUNDING FOR PROGRAM CATEGORIES CREATED BY
2626 LAW. A category required by law to be included in the categories
2727 established under Section 201.995(a) may only be initially
2828 implemented if the legislature makes a specific appropriation for
2929 the purpose of implementing the category.
3030 SECTION 2. This Act takes effect September 1, 2023.
