55 relating to the pediatric acute-onset neuropsychiatric syndrome
66 advisory council.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 119A.003, Health and Safety Code, is
99 amended by amending Subsection (a) and adding Subsection (d) to
1010 read as follows:
1111 (a) The advisory council is composed of the following 19
1212 members:
1313 (1) one member designated by the executive
1414 commissioner;
1515 (2) two members of the senate appointed by the
1616 lieutenant governor;
1717 (3) two members of the house of representatives
1818 appointed by the speaker of the house of representatives; and
1919 (4) 14 members appointed by the governor with the
2020 following qualifications:
2121 (A) three members who are health care providers,
2222 as defined by Section 161.201;
2323 (B) one member who is a licensed health care
2424 provider with expertise in treating persons with pediatric
2525 acute-onset neuropsychiatric syndrome, including pediatric
2626 autoimmune neuropsychiatric disorders associated with
2727 streptococcal infections, and autism;
2828 [(B) one member who is an osteopathic physician
2929 with experience treating persons with pediatric acute-onset
3030 neuropsychiatric syndrome, including pediatric autoimmune
3131 neuropsychiatric disorders associated with streptococcal
3232 infections;]
3333 (C) one member who is a pediatrician with
3434 experience treating persons with pediatric acute-onset
3535 neuropsychiatric syndrome, including pediatric autoimmune
3636 neuropsychiatric disorders associated with streptococcal
3737 infections;
3838 (D) one member who is a child psychiatrist with
3939 experience treating persons with pediatric acute-onset
4040 neuropsychiatric syndrome, including pediatric autoimmune
4141 neuropsychiatric disorders associated with streptococcal
4242 infections;
4343 (E) [one member who is an immunologist with
4444 experience treating persons with pediatric acute-onset
4545 neuropsychiatric syndrome, including pediatric autoimmune
4646 neuropsychiatric disorders associated with streptococcal
4747 infections, and the use of intravenous immunoglobulin;
4848 [(F) one member who is a dietician or
4949 nutritionist who provides services to children with autism spectrum
5050 disorders, attention-deficit/hyperactivity disorders, and other
5151 neuro-developmental conditions;
5252 [(G)] one member with experience in conducting
5353 research on pediatric acute-onset neuropsychiatric syndrome,
5454 including pediatric autoimmune neuropsychiatric disorders
5555 associated with streptococcal infections, obsessive-compulsive
5656 disorder, tic disorders, and other neurological disorders;
5757 (F) [(H)] one member who is [licensed by this
5858 state to practice as] a social worker;
5959 (G) [(I)] one member who is a representative of
6060 the Texas Education Agency with expertise in special education
6161 services;
6262 (H) [(J)] one member who is a psychologist
6363 licensed under Chapter 501, Occupations Code;
6464 (I) [(K)] one member who is a representative of a
6565 professional organization in this state for school nurses;
6666 (J) [(L)] one member who is a representative of
6767 an advocacy and support group in this state for individuals
6868 affected by pediatric acute-onset neuropsychiatric syndrome,
6969 including pediatric autoimmune neuropsychiatric disorders
7070 associated with streptococcal infections;
7171 (K) [(M)] one member who is a representative of
7272 an advocacy and support group in this state for individuals
7373 affected by autism; and
7474 (L) [(N)] one member who is a parent of a child
7575 who has been diagnosed with pediatric acute-onset neuropsychiatric
7676 syndrome or autism.
7777 (d) An advisory council member appointed under Subsection
7878 (a)(2) or (3) may designate another individual to serve in the
7979 member's place on the advisory council at the pleasure of the
8080 member. An advisory council member who designates another
8181 individual to serve in the member's place under this subsection
8282 shall provide written notification to the chair of the advisory
8383 council.
8484 SECTION 2. Section 119A.005, Health and Safety Code, is
8585 amended to read as follows:
8686 Sec. 119A.005. CHAIR AND VICE CHAIR. Members of the
8787 advisory council shall elect from among its [the legislative]
8888 members by a majority vote [of the advisory council] a chair and
8989 vice chair.
9090 SECTION 3. This Act takes effect September 1, 2023.
