5	5	relating to the pediatric acute-onset neuropsychiatric syndrome
6	6	advisory council.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 119A.003, Health and Safety Code, is
9	9	amended by amending Subsection (a) and adding Subsection (d) to
10	10	read as follows:
11	11	(a) The advisory council is composed of the following 19
12	12	members:
13	13	(1) one member designated by the executive
14	14	commissioner;
15	15	(2) two members of the senate appointed by the
16	16	lieutenant governor;
17	17	(3) two members of the house of representatives
18	18	appointed by the speaker of the house of representatives; and
19	19	(4) 14 members appointed by the governor with the
20	20	following qualifications:
21	21	(A) three members who are health care providers,
22	22	as defined by Section 161.201;
23	23	(B) one member who is a licensed health care
24	24	provider with expertise in treating persons with pediatric
25	25	acute-onset neuropsychiatric syndrome, including pediatric
26	26	autoimmune neuropsychiatric disorders associated with
27	27	streptococcal infections, and autism;
28	28	[(B) one member who is an osteopathic physician
29	29	with experience treating persons with pediatric acute-onset
30	30	neuropsychiatric syndrome, including pediatric autoimmune
31	31	neuropsychiatric disorders associated with streptococcal
32	32	infections;]
33	33	(C) one member who is a pediatrician with
34	34	experience treating persons with pediatric acute-onset
35	35	neuropsychiatric syndrome, including pediatric autoimmune
36	36	neuropsychiatric disorders associated with streptococcal
37	37	infections;
38	38	(D) one member who is a child psychiatrist with
39	39	experience treating persons with pediatric acute-onset
40	40	neuropsychiatric syndrome, including pediatric autoimmune
41	41	neuropsychiatric disorders associated with streptococcal
42	42	infections;
43	43	(E) [one member who is an immunologist with
44	44	experience treating persons with pediatric acute-onset
45	45	neuropsychiatric syndrome, including pediatric autoimmune
46	46	neuropsychiatric disorders associated with streptococcal
47	47	infections, and the use of intravenous immunoglobulin;
48	48	[(F) one member who is a dietician or
49	49	nutritionist who provides services to children with autism spectrum
50	50	disorders, attention-deficit/hyperactivity disorders, and other
51	51	neuro-developmental conditions;
52	52	[(G)] one member with experience in conducting
53	53	research on pediatric acute-onset neuropsychiatric syndrome,
54	54	including pediatric autoimmune neuropsychiatric disorders
55	55	associated with streptococcal infections, obsessive-compulsive
56	56	disorder, tic disorders, and other neurological disorders;
57	57	(F) [(H)] one member who is [licensed by this
58	58	state to practice as] a social worker;
59	59	(G) [(I)] one member who is a representative of
60	60	the Texas Education Agency with expertise in special education
61	61	services;
62	62	(H) [(J)] one member who is a psychologist
63	63	licensed under Chapter 501, Occupations Code;
64	64	(I) [(K)] one member who is a representative of a
65	65	professional organization in this state for school nurses;
66	66	(J) [(L)] one member who is a representative of
67	67	an advocacy and support group in this state for individuals
68	68	affected by pediatric acute-onset neuropsychiatric syndrome,
69	69	including pediatric autoimmune neuropsychiatric disorders
70	70	associated with streptococcal infections;
71	71	(K) [(M)] one member who is a representative of
72	72	an advocacy and support group in this state for individuals
73	73	affected by autism; and
74	74	(L) [(N)] one member who is a parent of a child
75	75	who has been diagnosed with pediatric acute-onset neuropsychiatric
76	76	syndrome or autism.
77	77	(d) An advisory council member appointed under Subsection
78	78	(a)(2) or (3) may designate another individual to serve in the
79	79	member's place on the advisory council at the pleasure of the
80	80	member. An advisory council member who designates another
81	81	individual to serve in the member's place under this subsection
82	82	shall provide written notification to the chair of the advisory
83	83	council.
84	84	SECTION 2. Section 119A.005, Health and Safety Code, is
85	85	amended to read as follows:
86	86	Sec. 119A.005. CHAIR AND VICE CHAIR. Members of the
87	87	advisory council shall elect from among its [the legislative]
88	88	members by a majority vote [of the advisory council] a chair and
89	89	vice chair.
90	90	SECTION 3. This Act takes effect September 1, 2023.
