77 relating to the study of public education performance.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle B, Title 2, Education Code, is amended
1010 by adding Chapter 9 to read as follows:
1111 CHAPTER 9. CENTER FOR PUBLIC EDUCATION PERFORMANCE INFORMATION
1212 Sec. 9.001. DEFINITIONS. In this chapter:
1313 (1) "Board" means the Center for Public Education
1414 Performance Information Board.
1515 (2) "Center" means the Center for Public Education
1616 Performance Information.
1717 Sec. 9.002. CENTER FOR PUBLIC EDUCATION PERFORMANCE
1818 INFORMATION. (a) The Center for Public Education Performance
1919 Information is created as an independent policy center.
2020 (b) The center shall represent business, finance, public
2121 policy, education, and other interests considered appropriate by
2222 the center.
2323 (c) In performing the duties provided by this chapter, the
2424 center shall:
2525 (1) work directly with the governor, lieutenant
2626 governor, speaker of the house of representatives, and members of
2727 the legislature; and
2828 (2) work with the agency and other state agencies,
2929 regional education service centers, school districts, and
3030 open-enrollment charter schools.
3131 Sec. 9.003. CENTER DUTIES. (a) The center shall promote
3232 the use of successful methods to increase performance at the school
3333 district and campus levels.
3434 (b) The center shall evaluate and rank the performance of
3535 each school district, campus, and open-enrollment charter school
3636 and provide a progress report and recommendations each year to:
3737 (1) the governor, lieutenant governor, speaker of the
3838 house of representatives, Legislative Budget Board, commissioner,
3939 and State Board of Education; and
4040 (2) districts, campuses, and open-enrollment charter
4141 schools.
4242 (c) The center may assist the legislature with policy
4343 studies related to the center's duties. The center may participate
4444 in collaborative studies with a foundation or organization inside
4545 or outside this state related to the center's duties.
4646 (d) The center shall seek information, data, and best
4747 practices from state, regional, and national sources to use in
4848 performing the center's duties provided by this chapter.
4949 (e) The center may contract with independent experts,
5050 academic scholars, and other appropriate professionals in
5151 performing the center's duties provided by this chapter.
5252 Sec. 9.004. BOARD. (a) The Center for Public Education
5353 Performance Information Board is created as the primary
5454 policy-making body of the center.
5555 (b) The board is composed of seven members. Members of the
5656 board shall be appointed as follows:
5757 (1) one member appointed by the governor;
5858 (2) one additional member appointed by the governor
5959 from a list of nominees submitted by the speaker of the house of
6060 representatives;
6161 (3) one member appointed by the lieutenant governor;
6262 (4) one member appointed by the commissioner;
6363 (5) one member appointed by the commissioner of higher
6464 education;
6565 (6) one member appointed by the chair of the State
6666 Board of Education; and
6767 (7) one member appointed by the chair of the Texas
6868 Workforce Commission.
6969 (c) In making an appointment under Subsection (b)(2), the
7070 governor may reject one or more nominees on a list submitted by the
7171 speaker of the house of representatives and request a new list of
7272 different nominees.
7373 (d) The board members appointed under this section must
7474 include individuals in the private sector who have an interest in
7575 improving performance in public education and significant
7676 experience in organizational management, finance, or business. A
7777 board member may not:
7878 (1) be a member of the board of trustees or an employee
7979 of a school district or a member of the governing body or an
8080 employee of or a charter holder of a charter for an open-enrollment
8181 charter school; or
8282 (2) have a financial relationship with a vendor or
8383 contractor who provides goods or services to any part of the public
8484 education system of this state.
8585 (e) Board members serve two-year terms.
8686 (f) Board members shall annually elect one member as the
8787 presiding officer.
8888 (g) A board member may not receive a salary for services as a
8989 board member but shall be reimbursed for expenses incurred in
9090 attending board meetings.
9191 Sec. 9.005. BOARD DUTIES. (a) The board shall study the
9292 elements of an effective and efficient system of public free
9393 schools and make recommendations to:
9494 (1) improve the performance of the public education
9595 system to meet the demands of the current century;
9696 (2) improve the state's ability to compete
9797 educationally and economically with other states and countries; and
9898 (3) provide the public with information on public
9999 education performance.
100100 (b) The board shall provide a report of the board's study
101101 and recommendations under Subsection (a) to:
102102 (1) the Legislative Budget Board at least once each
103103 year; and
104104 (2) the governor, lieutenant governor, speaker of the
105105 house of representatives, legislature, commissioner, and State
106106 Board of Education before the convening of each regular legislative
107107 session.
108108 Sec. 9.006. SUPPORT FOR PERFORMANCE OF DUTIES. (a) State
109109 agencies, regional education service centers, school districts,
110110 and open-enrollment charter schools shall fully cooperate with and
111111 assist the center at the board's request.
112112 (b) Data and information necessary to perform the center's
113113 duties under this chapter shall be provided at the board's request
114114 in a timely manner and at minimal cost. The board and center shall
115115 require confidentiality and other security measures for student
116116 data and information consistent with the Family Educational Rights
117117 and Privacy Act of 1974 (20 U.S.C. Section 1232g).
118118 Sec. 9.007. FUNDING. The center may be funded by donations,
119119 grants, and legislative appropriations.
120120 SECTION 2. This Act takes effect immediately if it receives
121121 a vote of two-thirds of all the members elected to each house, as
122122 provided by Section 39, Article III, Texas Constitution. If this
123123 Act does not receive the vote necessary for immediate effect, this
124124 Act takes effect September 1, 2023.
