55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to meetings held by certain conservation and reclamation
88 districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 36.064, Water Code, is amended by
1111 amending Subsection (b) and adding Subsection (c) to read as
1212 follows:
1313 (b) Except as provided by Subsection (c), meetings
1414 [Meetings] shall be conducted and notice of meetings shall be
1515 posted in accordance with [the Open Meetings Act,] Chapter 551,
1616 Government Code. A meeting of a committee of the board, or a
1717 committee composed of representatives of more than one board, where
1818 less than a quorum of any one board is present is not subject to the
1919 provisions of [the Open Meetings Act,] Chapter 551, Government
2020 Code.
2121 (c) Notwithstanding Sections 551.127 and 551.131,
2222 Government Code, the board may hold any regular or special meeting
2323 by videoconference call if a member of the board presiding over the
2424 meeting is physically present at a location that is open to the
2525 public during the open portions of the meeting.
2626 SECTION 2. Section 49.064, Water Code, is amended to read as
2727 follows:
2828 Sec. 49.064. MEETINGS. (a) The board shall hold such
2929 regular and special meetings as may be necessary for the proper
3030 conduct of the district's business. Except as otherwise provided
3131 by this section, all [All] meetings shall be conducted in
3232 accordance with [the open meetings law,] Chapter 551, Government
3333 Code. A meeting of a committee of the board, or a committee
3434 composed of representatives of more than one board, where less than
3535 a quorum of any one board is present is not subject to the
3636 provisions of [the open meetings law,] Chapter 551, Government
3737 Code.
3838 (b) Notwithstanding Sections 551.127 and 551.131,
3939 Government Code, the board may hold any regular or special meeting
4040 by videoconference call if a member of the board presiding over the
4141 meeting is physically present at one location of the meeting that is
4242 open to the public during the open portions of the meeting.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2023.
