| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 36.064, Water Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (b) and adding Subsection (c) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (b) Except as provided by Subsection (c), meetings |
|---|
| 14 | 14 | | [Meetings] shall be conducted and notice of meetings shall be |
|---|
| 15 | 15 | | posted in accordance with [the Open Meetings Act,] Chapter 551, |
|---|
| 16 | 16 | | Government Code. A meeting of a committee of the board, or a |
|---|
| 17 | 17 | | committee composed of representatives of more than one board, where |
|---|
| 18 | 18 | | less than a quorum of any one board is present is not subject to the |
|---|
| 19 | 19 | | provisions of [the Open Meetings Act,] Chapter 551, Government |
|---|
| 20 | 20 | | Code. |
|---|
| 21 | 21 | | (c) Notwithstanding Sections 551.127 and 551.131, |
|---|
| 22 | 22 | | Government Code, the board may hold any regular or special meeting |
|---|
| 23 | 23 | | by videoconference call if a member of the board presiding over the |
|---|
| 24 | 24 | | meeting is physically present at a location that is open to the |
|---|
| 25 | 25 | | public during the open portions of the meeting. |

| 26 | 26 | | SECTION 2. Section 49.064, Water Code, is amended to read as |
|---|
| 27 | 27 | | follows: |
|---|
| 28 | 28 | | Sec. 49.064. MEETINGS. (a) The board shall hold such |
|---|
| 29 | 29 | | regular and special meetings as may be necessary for the proper |
|---|
| 30 | 30 | | conduct of the district's business. Except as otherwise provided |
|---|
| 31 | 31 | | by this section, all [All] meetings shall be conducted in |
|---|
| 32 | 32 | | accordance with [the open meetings law,] Chapter 551, Government |
|---|
| 33 | 33 | | Code. A meeting of a committee of the board, or a committee |
|---|

|---|
| 44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 47 | | Act takes effect September 1, 2023. |
