66 AN ACT
77 relating to the establishment and use of the Texas Infrastructure
88 Fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 403, Government Code, is amended by
1111 adding Subchapter U to read as follows:
1212 SUBCHAPTER U. TEXAS INFRASTRUCTURE FUND
1313 Sec. 403.651. DEFINITION. In this subchapter, "fund" means
1414 the Texas Infrastructure Fund.
1515 Sec. 403.652. TEXAS INFRASTRUCTURE FUND. (a) The Texas
1616 Infrastructure Fund is established as a fund in the state treasury
1717 outside the general revenue fund.
1818 (b) The fund consists of:
1919 (1) money appropriated to the credit of the fund; and
2020 (2) the interest and other earnings attributable to
2121 the investment of money in the fund.
2222 (c) Money in the fund may be appropriated only to the
2323 comptroller for the purpose of awarding grants to public or private
2424 entities for infrastructure projects under this subchapter,
2525 including infrastructure projects involving:
2626 (1) water, ports, or other marine infrastructure;
2727 (2) broadband;
2828 (3) highways, toll roads, or bridges;
2929 (4) aviation;
3030 (5) rail; or
3131 (6) other transit infrastructure.
3232 Sec. 403.653. OVERSIGHT COMMITTEE. (a) The comptroller
3333 shall establish an oversight committee to make recommendations to
3434 the comptroller regarding the awarding of grants from money
3535 appropriated from the fund.
3636 (b) The oversight committee is composed of the following
3737 seven members:
3838 (1) the governor or the governor's designee;
3939 (2) the lieutenant governor or the lieutenant
4040 governor's designee;
4141 (3) the speaker of the house of representatives or the
4242 speaker's designee;
4343 (4) the commissioner of the General Land Office or the
4444 commissioner's designee;
4545 (5) the comptroller or the comptroller's designee;
4646 (6) the executive director of the Texas Department of
4747 Transportation or the executive director's designee; and
4848 (7) the chief financial officer of the Texas
4949 Department of Transportation or the officer's designee.
5050 Sec. 403.654. AWARD OF GRANTS. To the extent practicable,
5151 the comptroller shall award grants from money appropriated from the
5252 fund in a manner that:
5353 (1) takes into account the recommendations made to the
5454 comptroller by the oversight committee under Section 403.653;
5555 (2) ensures that the amount awarded for a specific
5656 type of infrastructure project does not exceed 50 percent of the
5757 amount appropriated from the fund; and
5858 (3) promotes and supports public-private partnerships
5959 that the comptroller determines:
6060 (A) are financially viable;
6161 (B) will diversify the methods of financing
6262 available for infrastructure projects; and
6363 (C) will reduce reliance on the issuance of
6464 general obligation bonds supported with state general revenue.
6565 Sec. 403.655. RULES. (a) The comptroller shall adopt rules
6666 regarding the awarding of grants from money appropriated from the
6767 fund, including rules regarding:
6868 (1) eligibility criteria for grant applicants;
6969 (2) grant application procedures;
7070 (3) criteria for evaluating grant applications and
7171 awarding grants;
7272 (4) guidelines related to grant amounts; and
7373 (5) procedures for monitoring the use of a grant and
7474 ensuring compliance with any conditions of the grant.
7575 (b) The rules adopted under Subsection (a) may include rules
7676 requiring a grantee to provide matching funds as a condition of the
7777 grant.
7878 SECTION 2. This Act takes effect September 1, 2023.
