| 5 | 5 | | relating to eligibility to participate as an annuitant in the state |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 1551.102, Insurance Code, is amended by |
|---|
| 9 | 9 | | adding Subsection (c-2) to read as follows: |
|---|
| 10 | 10 | | (c-2) An individual is eligible to participate in the group |
|---|
| 11 | 11 | | benefits program as provided by Subsection (a) if the individual: |
|---|
| 12 | 12 | | (1) was employed for at least 10 years by a school |
|---|
| 13 | 13 | | district established as specified by Section 19.002, Education |
|---|
| 14 | 14 | | Code, as the individual's last position of employment before |
|---|
| 15 | 15 | | retirement; |
|---|
| 16 | 16 | | (2) has at least: |
|---|
| 17 | 17 | | (A) 10 years of eligible service credit, |
|---|
| 18 | 18 | | including not more than five years of military service credited in |
|---|
| 19 | 19 | | the Employees Retirement System of Texas; or |
|---|
| 20 | 20 | | (B) five years of eligible service credit and is |
|---|
| 21 | 21 | | the sole surviving spouse of military personnel who was killed in |
|---|
| 22 | 22 | | action; and |
|---|
| 23 | 23 | | (3) retires under the jurisdiction of the Teacher |
|---|
| 24 | 24 | | Retirement System of Texas and: |
|---|
| 25 | 25 | | (A) has accumulated membership service credit as |
|---|
| 26 | 26 | | provided by Section 823.201(a), Government Code, in an amount so |
|---|
| 27 | 27 | | that the sum of the person's age and amount of membership service |
|---|
| 28 | 28 | | credit, including months of age and credit, equals or exceeds the |
|---|
| 29 | 29 | | number 80; or |
|---|
| 30 | 30 | | (B) is at least 65 years of age. |
|---|
| 31 | 31 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 32 | 32 | | to an individual who retires on or after the effective date of this |
|---|
| 33 | 33 | | Act. An individual who retires before the effective date of this |
|---|
| 34 | 34 | | Act is governed by the law as it existed immediately before that |
|---|
| 35 | 35 | | date, and the former law is continued in effect for that purpose. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2023. |
