| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 42.007, Election Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 42.007. COMBINING INCORPORATED AND UNINCORPORATED |
|---|
| 13 | 13 | | TERRITORY. A commissioners court may not establish a county |
|---|
| 14 | 14 | | election precinct containing territory inside a city with a |
|---|
| 15 | 15 | | population of 10,000 or more and unincorporated territory outside |
|---|
| 16 | 16 | | that city unless: |
|---|
| 17 | 17 | | (1) the commissioners court determines that either of |
|---|
| 18 | 18 | | the two areas: |
|---|
| 19 | 19 | | (A) [(1)] cannot constitute a separate election |
|---|
| 20 | 20 | | precinct of suitable size or shape that contains the permissible |
|---|
| 21 | 21 | | number of voters; or |
|---|
| 22 | 22 | | (B) [(2)] cannot be combined with other |
|---|
| 23 | 23 | | territory on the same side of the city boundary to form an election |
|---|
| 24 | 24 | | precinct of a suitable size or shape that contains the permissible |
|---|
| 25 | 25 | | number of voters without causing another election precinct to fail |
|---|
| 26 | 26 | | to meet those requirements; or |
|---|
| 27 | 27 | | (2) the two areas are located in a county |
|---|
| 28 | 28 | | participating in the countywide polling place program under Section |
|---|
| 29 | 29 | | 43.007. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2023. |
