55 relating to the administration of a local anesthetic agent by a
66 dental hygienist.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 258.001, Occupations Code, is amended to
99 read as follows:
1010 Sec. 258.001. IMPERMISSIBLE DELEGATIONS. A dentist may not
1111 delegate:
1212 (1) an act to an individual who, by board order, is
1313 prohibited from performing the act;
1414 (2) any of the following acts to a person not licensed
1515 as a dentist or dental hygienist:
1616 (A) the removal of calculus, deposits, or
1717 accretions from the natural and restored surfaces of exposed human
1818 teeth and restorations in the human mouth;
1919 (B) root planing or the smoothing and polishing
2020 of roughened root surfaces or exposed human teeth; or
2121 (C) any other act the delegation of which is
2222 prohibited by board rule;
2323 (3) any of the following acts to a person not licensed
2424 as a dentist:
2525 (A) comprehensive examination or diagnosis and
2626 treatment planning;
2727 (B) a surgical or cutting procedure on hard or
2828 soft tissue;
2929 (C) the prescription of a drug, medication, or
3030 work authorization;
3131 (D) the taking of an impression for a final
3232 restoration, appliance, or prosthesis;
3333 (E) the making of an intraoral occlusal
3434 adjustment;
3535 (F) direct pulp capping, pulpotomy, or any other
3636 endodontic procedure;
3737 (G) the final placement and intraoral adjustment
3838 of a fixed or removable appliance; or
3939 (H) the placement of any final restoration; [or]
4040 (4) the authority to an individual to administer a
4141 local anesthetic agent, inhalation sedative agent, parenteral
4242 sedative agent, or general anesthetic agent, including as a
4343 teledentistry dental service as that term is defined by Section
4444 111.001, if the individual is not licensed as:
4545 (A) a dentist with a permit issued by the board
4646 for the procedure being performed, if a permit is required;
4747 (B) a certified registered nurse anesthetist
4848 licensed by the Texas Board of Nursing, only if the delegating
4949 dentist holds a permit issued by the board for the procedure being
5050 performed, if a permit is required; or
5151 (C) a physician anesthesiologist licensed by the
5252 Texas Medical Board; or
5353 (5) the authority to a dental hygienist to administer
5454 a local anesthetic agent unless:
5555 (A) the dental hygienist:
5656 (i) administers the local anesthetic agent
5757 by infiltration for purposes of a procedure the dental hygienist is
5858 authorized to perform;
5959 (ii) has passed a board-approved
6060 certification examination relating to the administration of a local
6161 anesthetic agent;
6262 (iii) either:
6363 (a) has completed a board-approved
6464 course of study designed to train dental hygienists to administer a
6565 local anesthetic agent by infiltration; or
6666 (b) during the preceding year, was
6767 authorized to administer a local anesthetic agent by:
6868 (1) a branch of the United States
6969 armed forces; or
7070 (2) another state with clinical
7171 and didactic education requirements substantially equivalent to
7272 the requirements of a course approved by the board under
7373 Sub-subparagraph (a); and
7474 (iv) complies with any applicable rules
7575 adopted by the board establishing minimum standards for the
7676 administration of a local anesthetic agent;
7777 (B) the delegating dentist is physically present
7878 in the facility where the procedure is occurring and is
7979 continuously aware of the patient's physical status and well-being;
8080 and
8181 (C) the patient to whom the local anesthetic
8282 agent is administered is:
8383 (i) at least 18 years of age; and
8484 (ii) not sedated, or is sedated using only
8585 nitrous oxide-oxygen inhalation.
8686 SECTION 2. Section 262.002(a), Occupations Code, is amended
8787 to read as follows:
8888 (a) A person practices dental hygiene if the person:
8989 (1) removes accumulated matter, tartar, deposits,
9090 accretions, or stains, other than mottled enamel stains, from the
9191 natural and restored surface of exposed human teeth and
9292 restorations in the human mouth;
9393 (2) smoothes roughened root surfaces;
9494 (3) polishes exposed human teeth, restorations in the
9595 human mouth, or roughened root surfaces;
9696 (4) topically applies drugs to the surface tissues of
9797 the human mouth or the exposed surface of human teeth;
9898 (5) makes dental x-rays; [and]
9999 (6) administers a local anesthetic agent under the
100100 authorization and supervision of a dentist in compliance with
101101 Section 258.001(5); and
102102 (7) performs any other service, task, or procedure
103103 prescribed by board rule.
104104 SECTION 3. (a) Not later than January 1, 2024, the State
105105 Board of Dental Examiners shall:
106106 (1) prescribe by rule the requirements for a course to
107107 train dental hygienists to administer a local anesthetic agent
108108 consistent with Section 258.001, Occupations Code, as amended by
109109 this Act;
110110 (2) develop a procedure for the approval of courses
111111 described by Subdivision (1) of this subsection; and
112112 (3) adopt rules to administer Sections 258.001 and
113113 262.002, Occupations Code, as amended by this Act, including rules
114114 to establish the minimum standards for the administration of a
115115 local anesthetic agent by a dental hygienist consistent with those
116116 sections.
117117 (b) A rule adopted under Subsection (a)(1) of this section
118118 must require that a course be offered in a classroom setting at an
119119 educational institution accredited by the Commission on Dental
120120 Accreditation of the American Dental Association.
121121 SECTION 4. This Act takes effect September 1, 2023.
