| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 48, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 48.116 to read as follows: |
|---|
| 12 | 12 | | Sec. 48.116. FINE ARTS ALLOTMENT. (a) For each student in |
|---|
| 13 | 13 | | average daily attendance enrolled in a fine arts education course |
|---|
| 14 | 14 | | approved by the agency under Subsection (b) in grades 6 through 12, |
|---|
| 15 | 15 | | a school district is entitled to an annual allotment equal to the |
|---|
| 16 | 16 | | basic allotment, or, if applicable, the sum of the basic allotment |
|---|
| 17 | 17 | | and the allotment under Section 48.101 to which the district is |
|---|
| 18 | 18 | | entitled, multiplied by: |
|---|
| 19 | 19 | | (1) 1.3 for a student in grades 6 through 8; |
|---|
| 20 | 20 | | (2) 1.2 for a student in grade 9 or 10; and |
|---|
| 21 | 21 | | (3) 1.1 for a student in grade 11 or 12. |
|---|
| 22 | 22 | | (b) The agency shall approve fine arts education courses |
|---|
| 23 | 23 | | that qualify for the allotment provided under this section. The |
|---|
| 24 | 24 | | approved courses must include fine arts education courses that: |
|---|
| 25 | 25 | | (1) are authorized by the State Board of Education, |
|---|
| 26 | 26 | | including music, art, theater, and dance; |
|---|
| 27 | 27 | | (2) provide students with the knowledge and skills |
|---|
| 28 | 28 | | necessary for success in the fine arts; and |
|---|
| 29 | 29 | | (3) require a student in full-time attendance to |
|---|
| 30 | 30 | | receive not less than 225 minutes of fine arts instruction per week. |
|---|
| 31 | 31 | | (c) Of the funds allocated under this section: |
|---|
| 32 | 32 | | (1) at least 25 percent of the funds allocated under |
|---|
| 33 | 33 | | Subsection (a)(1) must be used in a manner that prioritizes |
|---|
| 34 | 34 | | providing fine arts education to students in grades six through |
|---|
| 35 | 35 | | eight who are eligible for the compensatory education allotment |
|---|
| 36 | 36 | | under Section 48.104; |
|---|
| 37 | 37 | | (2) 50 percent of the total funds allocated under this |
|---|
| 38 | 38 | | section must be used to provide fine arts education courses to |
|---|
| 39 | 39 | | students in grades six through eight; and |
|---|
| 40 | 40 | | (3) except as necessary to meet the requirement under |
|---|
| 41 | 41 | | Subdivision (2), at least 75 percent of funds allocated under |
|---|
| 42 | 42 | | Subsections (a)(2) and (3) must be used to provide fine arts |
|---|
| 43 | 43 | | education courses to students in grades 9 through 12. |
|---|
| 44 | 44 | | (d) The agency shall annually publish a list of fine arts |
|---|
| 45 | 45 | | courses approved under Subsection (b). |
|---|
| 46 | 46 | | SECTION 2. This Act takes effect September 1, 2023. |
