| 7 | 7 | | relating to a school district's duty to notify certain parents or |

| 8 | 8 | | guardians of a program providing students with reading disabilities |

| 9 | 9 | | the ability to borrow audiobooks free of charge. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 28.006(g-2), Education Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (g-2) In accordance with a notification program developed |
|---|
| 14 | 14 | | by the commissioner by rule, a school district shall notify the |
|---|
| 15 | 15 | | parent or guardian of each student determined, on the basis of a |
|---|
| 16 | 16 | | screening under Section 38.003 or other basis, to have a reading |
|---|
| 17 | 17 | | disability or dyslexia or a related disorder[, or determined, on |
|---|
| 18 | 18 | | the basis of reading instrument results, to be at risk for dyslexia |
|---|
| 19 | 19 | | or other reading difficulties,] of the program maintained by the |
|---|
| 20 | 20 | | Texas State Library and Archives Commission providing students with |
|---|
| 21 | 21 | | reading disabilities the ability to borrow audiobooks free of |
|---|
| 22 | 22 | | charge. |

| 23 | 23 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 24 | 24 | | school year. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2023. |
