66 AN ACT
77 relating to the disposal of certain instructional materials by a
88 public school.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 31.105(c), Education Code, is amended to
1111 read as follows:
1212 (c) The board of trustees of a school district or governing
1313 body of an open-enrollment charter school may dispose of printed
1414 instructional material before the date the instructional material
1515 is discontinued for use in the public schools by the State Board of
1616 Education if the board of trustees or governing body determines
1717 that the instructional material is not needed by the district or
1818 school and the board of trustees or governing body does not
1919 reasonably expect that the instructional material will be
2020 needed. [A district or school must notify the commissioner of any
2121 instructional material the district or school disposes of under
2222 this subsection.]
2323 SECTION 2. This Act takes effect September 1, 2023.
