| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 31.105(c), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (c) The board of trustees of a school district or governing |
|---|
| 13 | 13 | | body of an open-enrollment charter school may dispose of printed |
|---|
| 14 | 14 | | instructional material before the date the instructional material |
|---|
| 15 | 15 | | is discontinued for use in the public schools by the State Board of |
|---|
| 16 | 16 | | Education if the board of trustees or governing body determines |
|---|
| 17 | 17 | | that the instructional material is not needed by the district or |
|---|
| 18 | 18 | | school and the board of trustees or governing body does not |
|---|
| 19 | 19 | | reasonably expect that the instructional material will be |
|---|
| 20 | 20 | | needed. [A district or school must notify the commissioner of any |
|---|
| 21 | 21 | | instructional material the district or school disposes of under |
|---|
| 22 | 22 | | this subsection.] |

| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
