55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the duties of a public school counselor.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 33.006(a) and (b), Education Code, are
1010 amended to read as follows:
1111 (a) The primary responsibility of a school counselor is to
1212 counsel students to fully develop each student's academic, career,
1313 and personal[, and social] abilities.
1414 (b) In addition to a school counselor's responsibility
1515 under Subsection (a), the school counselor shall:
1616 (1) participate in planning, implementing, and
1717 evaluating a comprehensive developmental school counseling
1818 [guidance] program to serve all students and to address the special
1919 needs of students:
2020 (A) who are at risk of dropping out of school,
2121 becoming substance abusers, participating in gang activity, or
2222 committing suicide;
2323 (B) who are at risk of:
2424 (i) choosing an unhealthy or inappropriate
2525 solution to a problem; or
2626 (ii) engaging in harmful behavior toward
2727 the student's self or others;
2828 (C) who are in need of modified instructional
2929 strategies; or
3030 (D) [(C)] who are gifted and talented, with
3131 emphasis on identifying and serving gifted and talented students
3232 who are educationally disadvantaged;
3333 (2) consult with a student's parent or guardian and
3434 make referrals as appropriate in consultation with the student's
3535 parent or guardian;
3636 (3) consult with school staff, parents, and other
3737 community members to help them increase the effectiveness of
3838 student education and promote student success;
3939 (4) coordinate people and resources in the school,
4040 home, and community;
4141 (5) with the assistance of school staff, interpret
4242 standardized test results and other assessment data that help a
4343 student make educational and career plans;
4444 (6) deliver classroom guidance activities or serve as
4545 a consultant to teachers conducting lessons based on the school's
4646 guidance curriculum; and
4747 (7) serve as an impartial, nonreporting resource for
4848 interpersonal conflicts and discord involving two or more students,
4949 including accusations of bullying under Section 37.0832.
5050 SECTION 2. This Act applies beginning with the 2023-2024
5151 school year.
5252 SECTION 3. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2023.
