| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Chapter 442, Government Code, is amended by |
|---|
| 14 | 14 | | adding Subchapter B-2 to read as follows: |
|---|
| 15 | 15 | | SUBCHAPTER B-2. IWO JIMA MONUMENT AND MUSEUM |
|---|
| 16 | 16 | | Sec. 442.065. DEFINITION. In this subchapter, "monument |
|---|
| 17 | 17 | | and museum" means the Iwo Jima monument and museum at the Marine |
|---|
| 18 | 18 | | Military Academy in Harlingen, Texas. |
|---|
| 19 | 19 | | Sec. 442.066. IWO JIMA MONUMENT AND MUSEUM; FUND. (a) To |
|---|
| 20 | 20 | | the extent authorized by law, the commission may enter into a |
|---|
| 21 | 21 | | contract with the nonprofit entity that owns the monument and |
|---|
| 22 | 22 | | museum to transfer to the commission the operation and management |
|---|
| 23 | 23 | | of the monument and museum. |
|---|
| 24 | 24 | | (b) The contract authorized by this section must include |
|---|
| 25 | 25 | | provisions for: |
|---|
| 26 | 26 | | (1) expanding, renovating, managing, maintaining, |
|---|
| 27 | 27 | | operating, or providing financial support for the monument and |
|---|
| 28 | 28 | | museum, including administration, construction and operation of a |
|---|
| 29 | 29 | | visitor center, and related activities; |
|---|
| 30 | 30 | | (2) preserving military documents, relics, and other |
|---|
| 31 | 31 | | items of historical interest; |
|---|
| 32 | 32 | | (3) employing a museum director and other employees |
|---|
| 33 | 33 | | the commission considers necessary to fulfill its duties and |
|---|
| 34 | 34 | | responsibilities under the contract; |
|---|
| 35 | 35 | | (4) accepting donations of money, property, and |
|---|
| 36 | 36 | | historical relics; and |
|---|
| 37 | 37 | | (5) acquiring property and historical relics with |
|---|
| 38 | 38 | | funds available for that purpose. |
|---|
| 39 | 39 | | (c) The Iwo Jima monument and museum fund is created as a |
|---|
| 40 | 40 | | fund outside the state treasury. The commission shall administer |
|---|
| 41 | 41 | | the fund but may contract with the nonprofit entity that owns the |
|---|
| 42 | 42 | | monument and museum for administration of the fund. The fund |
|---|
| 43 | 43 | | consists of: |
|---|
| 44 | 44 | | (1) admissions revenue from the operation of the |
|---|
| 45 | 45 | | monument and museum; |
|---|
| 46 | 46 | | (2) sales revenue from the operation of the monument |
|---|
| 47 | 47 | | and museum gift shop; and |
|---|
| 48 | 48 | | (3) donations made to the commission for the monument |
|---|
| 49 | 49 | | and museum. |
|---|
| 50 | 50 | | (d) Money in the Iwo Jima monument and museum fund may be |
|---|
| 51 | 51 | | spent without legislative appropriation and only to administer, |
|---|
| 52 | 52 | | operate, preserve, repair, expand, or otherwise maintain the |
|---|
| 53 | 53 | | monument and museum. |
|---|
| 54 | 54 | | (e) Interest and income from the assets of the Iwo Jima |
|---|
| 55 | 55 | | monument and museum fund shall be credited to and deposited in the |
|---|
| 56 | 56 | | fund. |
|---|
| 57 | 57 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 58 | 58 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 59 | 59 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 60 | 60 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 61 | 61 | | Act takes effect September 1, 2023. |
