99 AN ACT
1010 relating to the operation and management of the Iwo Jima monument
1111 and museum by the Texas Historical Commission.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 442, Government Code, is amended by
1414 adding Subchapter B-2 to read as follows:
1515 SUBCHAPTER B-2. IWO JIMA MONUMENT AND MUSEUM
1616 Sec. 442.065. DEFINITION. In this subchapter, "monument
1717 and museum" means the Iwo Jima monument and museum at the Marine
1818 Military Academy in Harlingen, Texas.
1919 Sec. 442.066. IWO JIMA MONUMENT AND MUSEUM; FUND. (a) To
2020 the extent authorized by law, the commission may enter into a
2121 contract with the nonprofit entity that owns the monument and
2222 museum to transfer to the commission the operation and management
2323 of the monument and museum.
2424 (b) The contract authorized by this section must include
2525 provisions for:
2626 (1) expanding, renovating, managing, maintaining,
2727 operating, or providing financial support for the monument and
2828 museum, including administration, construction and operation of a
2929 visitor center, and related activities;
3030 (2) preserving military documents, relics, and other
3131 items of historical interest;
3232 (3) employing a museum director and other employees
3333 the commission considers necessary to fulfill its duties and
3434 responsibilities under the contract;
3535 (4) accepting donations of money, property, and
3636 historical relics; and
3737 (5) acquiring property and historical relics with
3838 funds available for that purpose.
3939 (c) The Iwo Jima monument and museum fund is created as a
4040 fund outside the state treasury. The commission shall administer
4141 the fund but may contract with the nonprofit entity that owns the
4242 monument and museum for administration of the fund. The fund
4343 consists of:
4444 (1) admissions revenue from the operation of the
4545 monument and museum;
4646 (2) sales revenue from the operation of the monument
4747 and museum gift shop; and
4848 (3) donations made to the commission for the monument
4949 and museum.
5050 (d) Money in the Iwo Jima monument and museum fund may be
5151 spent without legislative appropriation and only to administer,
5252 operate, preserve, repair, expand, or otherwise maintain the
5353 monument and museum.
5454 (e) Interest and income from the assets of the Iwo Jima
5555 monument and museum fund shall be credited to and deposited in the
5656 fund.
5757 SECTION 2. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2023.
