8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 550.041(a), Transportation Code, is |
---|
10 | 10 | | amended to read as follows: |
---|
11 | 11 | | (a) A peace officer who is notified of a motor vehicle |
---|
12 | 12 | | accident resulting in injury to or death of a person or property |
---|
13 | 13 | | damage to an apparent extent of at least $5,000 [$1,000] may |
---|
14 | 14 | | investigate the accident and file justifiable charges relating to |
---|
15 | 15 | | the accident without regard to whether the accident occurred on |
---|
16 | 16 | | property to which this chapter applies. |
---|
17 | 17 | | SECTION 2. Section 550.062(a), Transportation Code, is |
---|
18 | 18 | | amended to read as follows: |
---|
19 | 19 | | (a) A law enforcement officer who in the regular course of |
---|
20 | 20 | | duty investigates a motor vehicle accident shall make a written |
---|
21 | 21 | | report of the accident if the accident resulted in injury to or the |
---|
22 | 22 | | death of a person or damage to the property of any one person to the |
---|
23 | 23 | | apparent extent of $5,000 [$1,000] or more. |
---|
24 | 24 | | SECTION 3. Section 601.151(a), Transportation Code, is |
---|
25 | 25 | | amended to read as follows: |
---|
26 | 26 | | (a) This subchapter applies only to a motor vehicle accident |
---|
27 | 27 | | in this state that results in bodily injury or death or in damage to |
---|
28 | 28 | | the property of one person of at least $5,000 [$1,000]. |
---|
29 | 29 | | SECTION 4. The change in law made by this Act applies only |
---|
30 | 30 | | to a motor vehicle accident occurring on or after the effective date |
---|
31 | 31 | | of this Act. A motor vehicle accident occurring before the |
---|
32 | 32 | | effective date of this Act is covered by the law in effect on the |
---|
33 | 33 | | date the accident occurred, and the former law is continued in |
---|
34 | 34 | | effect for that purpose. |
---|
35 | 35 | | SECTION 5. This Act takes effect September 1, 2023. |
