1919 AN ACT
2020 relating to the prosecution of the offense of fraudulent use or
2121 possession of credit card or debit card information.
2222 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
2323 SECTION 1. Chapter 13, Code of Criminal Procedure, is
2424 amended by adding Article 13.292 to read as follows:
2525 Art. 13.292. FRAUDULENT USE OR POSSESSION OF CREDIT CARD OR
2626 DEBIT CARD INFORMATION. An offense under Section 32.315, Penal
2727 Code, may be prosecuted in any county in which the offense was
2828 committed or in the county of residence for any person whose credit
2929 card or debit card information was unlawfully obtained, possessed,
3030 transferred, or used by the defendant.
3131 SECTION 2. Article 38.19(a), Code of Criminal Procedure, is
3232 amended to read as follows:
3333 (a) This article applies to the trial of an offense under
3434 any of the following sections of the Penal Code:
3535 (1) Section 32.21 (Forgery);
3636 (2) Section 32.31 (Credit Card or Debit Card Abuse);
3737 [or]
3838 (3) Section 32.51 (Fraudulent Use or Possession of
3939 Identifying Information); or
4040 (4) Section 32.315 (Fraudulent Use or Possession of
4141 Credit Card or Debit Card Information).
4242 SECTION 3. The changes in law made by this Act apply only to
4343 a criminal proceeding that commences on or after the effective date
4444 of this Act. A criminal proceeding that commenced before the
4545 effective date of this Act is governed by the law in effect on the
4646 date the proceeding commenced, and the former law is continued in
4747 effect for that purpose.
4848 SECTION 4. This Act takes effect September 1, 2023.
