77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subtitle B, Title 4, Government Code, is amended
99 by adding Chapter 425 to read as follows:
1010 CHAPTER 425. PEACE OFFICER WELLNESS PROGRAM
1111 SUBCHAPTER A. GENERAL PROVISIONS
1212 Sec. 425.001. DEFINITIONS. In this chapter:
1313 (1) "Commission" means the Health and Human Services
1414 Commission.
1515 (2) "Fund" means the peace officer wellness fund.
1616 (3) "Law enforcement agency" means a state agency or
1717 political subdivision of this state that employs at least 20 peace
1818 officers described by Article 2.12(1), (3), (4), (8), or (10), Code
1919 of Criminal Procedure, to answer emergency calls for service or
2020 conduct patrol operations, traffic enforcement, or criminal
2121 investigations.
2222 (4) "Violent incident" means an incident involving a
2323 peace officer that occurs while the officer is performing official
2424 duties and that poses a substantial risk of serious harm to the
2525 officer's mental health or well-being, including responding to a
2626 homicide, suicide, or fatal motor vehicle accident.
2727 SUBCHAPTER B. WELLNESS PROGRAM
2828 Sec. 425.051. ESTABLISHMENT OF PROGRAM. A law enforcement
2929 agency may establish and maintain a wellness program for the
3030 agency's peace officers.
3131 Sec. 425.052. PROGRAM REQUIREMENTS. A law enforcement
3232 agency that establishes a wellness program must ensure the program
3333 complies with any requirements established by the commission and is
3434 available to each peace officer who has routinely responded to and
3535 may have been affected by a violent incident. The program at a
3636 minimum must provide:
3737 (1) an initial telephone call or other form of contact
3838 from an agency representative to monitor the mental and physical
3939 well-being of a peace officer who may have been affected by a
4040 violent incident; and
4141 (2) information regarding mental health resources,
4242 including counseling and therapy services, to a peace officer who
4343 is struggling to cope with the effect on the officer of responding
4444 to a violent incident.
4545 SUBCHAPTER C. PEACE OFFICER WELLNESS FUND AND GRANT PROGRAM
4646 Sec. 425.101. FUND. (a) The peace officer wellness fund is
4747 an account in the general revenue fund.
4848 (b) The fund is composed of:
4949 (1) money appropriated to the fund by the legislature;
5050 (2) gifts and grants contributed to the fund; and
5151 (3) the earnings of the fund.
5252 (c) Money in the fund may be appropriated only to the
5353 commission. The commission may use the money only for making grants
5454 under Section 425.102.
5555 Sec. 425.102. PEACE OFFICER WELLNESS GRANT PROGRAM. (a)
5656 The commission shall establish and administer a grant program to
5757 assist law enforcement agencies in establishing and maintaining
5858 peace officer wellness programs as required under Subchapter B.
5959 (b) The commission shall establish:
6060 (1) eligibility criteria for grant applicants;
6161 (2) grant application procedures;
6262 (3) guidelines relating to grant amounts;
6363 (4) procedures for evaluating grant applications;
6464 (5) guidelines relating to the use of a grant awarded
6565 under the program, including the reimbursement of costs associated
6666 with the provision of counseling and therapy services to peace
6767 officers participating in a wellness program; and
6868 (6) procedures for monitoring the use of a grant
6969 awarded under the program and ensuring compliance with any
7070 condition of a grant.
7171 SECTION 2. Not later than January 1, 2024, the executive
7272 commissioner of the Health and Human Services Commission shall
7373 prescribe any necessary requirements for peace officer wellness
7474 programs established under Chapter 425, Government Code, as added
7575 by this Act.
7676 SECTION 3. This Act takes effect September 1, 2023.
