55 relating to the liability of county tax assessor-collectors for

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 520, Transportation Code,
99 is amended by adding Section 520.0072 to read as follows:
1010 Sec. 520.0072. LIABILITY OF COUNTY TAX ASSESSOR-COLLECTOR
1111 FOR CERTAIN ACTS OF DEPUTIES. Notwithstanding any other law, a
1212 county tax assessor-collector may not be held liable for an offense
1313 or damages arising from the misuse of license plates or other
1414 fraudulent activity related to vehicle registration and titling by
1515 an individual or business entity deputized by the county tax
1616 assessor-collector to perform titling services in accordance with
1717 rules adopted under Section 520.0071(a).
1818 SECTION 2. (a) The change in law made by this Act applies
1919 only to a cause of action that accrues on or after the effective
2020 date of this Act. A cause of action that accrues before the
2121 effective date of this Act is governed by the law applicable to the
2222 cause of action immediately before the effective date of this Act,
2323 and that law is continued in effect for that purpose.
2424 (b) The change in law made by this Act applies only to an
2525 offense committed on or after the effective date of this Act. An
2626 offense committed before the effective date of this Act is governed
2727 by the law in effect on the date the offense was committed, and the
2828 former law is continued in effect for that purpose. For purposes of
2929 this section, an offense was committed before the effective date of
3030 this Act if any element of the offense occurred before that date.
3131 SECTION 3. This Act takes effect September 1, 2023.
