7	7	relating to the retirement eligibility of certain peace officers
8	8	who are members of the Teacher Retirement System of Texas.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 824.202, Government Code, is amended by
11	11	amending Subsections (a-2), (b-2), and (d-2) and adding Subsections
12	12	(a-3), (b-3), and (d-3) to read as follows:
13	13	(a-2) Except as provided by Subsection (a-3), this [This]
14	14	subsection applies only to a person who does not have at least five
15	15	years of service credit in the retirement system on or before August
16	16	31, 2014, or who becomes a member of the retirement system on or
17	17	after September 1, 2014. A member subject to this subsection is
18	18	eligible to retire and receive a standard service retirement
19	19	annuity if:
20	20	(1) the member is at least 65 years old and has at
21	21	least five years of service credit in the retirement system; or
22	22	(2) the member is at least 62 years old and has at
23	23	least five years of service credit in the retirement system and the
24	24	sum of the member's age and amount of service credit in the
25	25	retirement system equals the number 80.
26	26	(a-3) Subsection (a-2) does not apply to a member who is a
27	27	peace officer licensed under Subchapter G, Chapter 1701,
28	28	Occupations Code, and who is employed and commissioned as a peace
29	29	officer under Section 37.081 or 51.203, Education Code, and
30	30	assigned to the duty of a peace officer at the time the member
31	31	retires. A person described by this subsection is subject to
32	32	Subsection (a) or (a-1), as appropriate. This subsection does not
33	33	apply to a member who is employed as security personnel under
34	34	Section 37.081, Education Code, and assigned to the duty of
35	35	security personnel at the time the member retires.
36	36	(b-2) Except as provided by Subsection (b-3), this [This]
37	37	subsection applies only to a person who does not have at least five
38	38	years of service credit in the retirement system on or before August
39	39	31, 2014, or who becomes a member of the retirement system on or
40	40	after September 1, 2014. If a member subject to this subsection is
41	41	at least 55 years old and has at least five years of service credit
42	42	in the retirement system, but does not meet the requirements under
43	43	Subsection (d-2), the member is eligible to retire and receive a
44	44	service retirement annuity reduced from the standard service
45	45	retirement annuity available under Subsection (a-2)(1), to a
46	46	percentage derived from the following table:

58	58	peace officer licensed under Subchapter G, Chapter 1701,

60	60	officer under Section 37.081 or 51.203, Education Code, and
61	61	assigned to the duty of a peace officer at the time the member
62	62	retires. A person described by this subsection is subject to
63	63	Subsection (b) or (b-1), as appropriate. This subsection does not
64	64	apply to a member who is employed as security personnel under
65	65	Section 37.081, Education Code, and assigned to the duty of
66	66	security personnel at the time the member retires.
67	67	(d-2) Except as provided by Subsection (d-3), this [This]
68	68	subsection applies only to a person who does not have at least five
69	69	years of service credit in the retirement system on or before August
70	70	31, 2014, or who becomes a member of the retirement system on or
71	71	after September 1, 2014. If the sum of the member's age and amount
72	72	of service credit in the retirement system equals the number 80,
73	73	with at least five years of service credit, or if the member has at
74	74	least 30 years of service credit in the retirement system, the
75	75	member is eligible to retire regardless of age and receive a service
76	76	retirement annuity consisting of the standard service retirement
77	77	annuity available under Subsection (a-2)(2) decreased by five
78	78	percent for each year of age under 62 years.
79	79	(d-3) Subsection (d-2) does not apply to a member who is a
80	80	peace officer licensed under Subchapter G, Chapter 1701,
81	81	Occupations Code, and who is employed and commissioned as a peace
82	82	officer under Section 37.081 or 51.203, Education Code, and
83	83	assigned to the duty of a peace officer at the time the member
84	84	retires. A person described by this subsection is subject to
85	85	Subsection (d) or (d-1), as appropriate. This subsection does not
86	86	apply to a member who is employed as security personnel under
87	87	Section 37.081, Education Code, and assigned to the duty of
88	88	security personnel at the time the member retires.
89	89	SECTION 2. Section 824.202, Government Code, as amended by
90	90	this Act, applies only to a peace officer who is a member of the
91	91	Teacher Retirement System of Texas and who retires on or after the
92	92	effective date of this Act. A peace officer who is a member of the
93	93	Teacher Retirement System of Texas and who retires before the
94	94	effective date of this Act is subject to the law in effect on the
95	95	date the peace officer retired, and that law is continued in effect
96	96	for that purpose.
97	97	SECTION 3. This Act takes effect September 1, 2023.
