77 relating to hiring and employment requirements for persons in
88 direct contact with children at certain facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 9, Health and Safety Code, is amended by
1111 adding Subtitle D to read as follows:
1212 SUBTITLE D. CHILD SAFETY
1313 CHAPTER 810. EMPLOYMENT REQUIREMENTS FOR CERTAIN FACILITIES TO
1414 PREVENT PHYSICAL OR SEXUAL ABUSE OF CHILDREN
1515 Sec. 810.001. DEFINITIONS. In this chapter:
1616 (1) "Commission" means the Health and Human Services
1717 Commission.
1818 (2) "Department" means the Texas Juvenile Justice
1919 Department.
2020 (3) "Facility" means:
2121 (A) a residential treatment facility or group
2222 home licensed or otherwise regulated by the commission;
2323 (B) a juvenile detention facility regulated by
2424 the department; or
2525 (C) a shelter operated by or under the authority
2626 of a county or municipality that provides temporary living
2727 accommodations for individuals who are homeless.
2828 Sec. 810.002. APPLICABILITY. This chapter applies only to
2929 the following governmental entities:
3030 (1) the commission;
3131 (2) the department;
3232 (3) a county; and
3333 (4) a municipality.
3434 Sec. 810.003. REQUIRED CRIMINAL HISTORY RECORD INFORMATION
3535 REVIEW AND EMPLOYMENT VERIFICATION. (a) A governmental entity to
3636 which this chapter applies shall ensure that each facility the
3737 entity regulates or operates reviews state and federal criminal
3838 history record information and conducts an employment verification
3939 for each person:
4040 (1) who is:
4141 (A) an applicant for employment with the
4242 facility;
4343 (B) an employee of the facility;
4444 (C) a volunteer with the facility;
4545 (D) an applicant for a volunteer position with
4646 the facility;
4747 (E) an applicant for an independent contractor
4848 position with the facility; or
4949 (F) an independent contractor of the facility;
5050 and
5151 (2) who may be placed in direct contact with a child
5252 receiving services at the facility.
5353 (b) For purposes of Subsection (a)(2), a person may be
5454 placed in direct contact with a child if the person's position might
5555 potentially require the person to:
5656 (1) provide care, supervision, or guidance to a child;
5757 (2) exercise any form of control over a child; or
5858 (3) have routine interactions with a child.
5959 (c) In conducting an employment verification under
6060 Subsection (a), the facility must at a minimum contact the previous
6161 employers listed in the submitted application materials for each
6262 applicant.
6363 (d) Each facility shall obtain electronic updates from the
6464 Department of Public Safety of arrests and convictions for each
6565 person:
6666 (1) described by Subsection (a)(1)(B), (C), or (F);
6767 and
6868 (2) who continues as an employee, volunteer, or
6969 independent contractor or who otherwise continues to have direct
7070 contact with a child at the facility.
7171 Sec. 810.004. EFFECT OF CERTAIN CRIMINAL CONVICTIONS OR
7272 CHILD ABUSE ALLEGATIONS. (a) A facility may not offer a person an
7373 employment, volunteer, or independent contractor position and must
7474 terminate the person's position if, based on a criminal history
7575 record information review or an employment verification of that
7676 person, the facility discovers the person:
7777 (1) engaged in physical or sexual abuse of a child
7878 constituting an offense under Section 21.02, 22.011, 22.021, or
7979 25.02, Penal Code; or
8080 (2) was terminated from a previous position based on
8181 allegations of having engaged in conduct described by Subdivision
8282 (1).
8383 (b) A separation agreement for a facility employee,
8484 volunteer, or independent contractor may not include a provision
8585 that prohibits disclosure to a prospective employer of an
8686 allegation of conduct constituting an offense under Section 21.02,
8787 22.011, 22.021, or 25.02, Penal Code.
8888 Sec. 810.005. TRAINING REQUIREMENTS. A facility must
8989 provide training to each employee, volunteer, or independent
9090 contractor who may be placed in direct contact with a child. The
9191 training must include:
9292 (1) recognition of the signs of physical and sexual
9393 abuse and reporting requirements for suspected physical and sexual
9494 abuse;
9595 (2) the facility's policies related to reporting of
9696 physical and sexual abuse; and
9797 (3) methods for maintaining professional and
9898 appropriate relationships with children.
9999 SECTION 2. Section 810.004(b), Health and Safety Code, as
100100 added by this Act, applies only to an agreement entered into on or
101101 after the effective date of this Act.
102102 SECTION 3. This Act takes effect September 1, 2023.
