55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to general definitions for and collection of governmental
88 information regarding biological sex.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. FINDINGS. The legislature finds that:
1111 (1) males and females possess unique immutable
1212 biological differences that manifest prior to birth and increase as
1313 individuals age and experience puberty;
1414 (2) biological differences between the sexes mean that
1515 only females are able to get pregnant, give birth, and breastfeed
1616 children;
1717 (3) biological differences between the sexes mean that
1818 males are, on average, bigger, stronger, and faster than females;
1919 (4) biological differences between the sexes leave
2020 females more physically vulnerable than males to specific forms of
2121 violence, including sexual violence;
2222 (5) females have historically suffered discrimination
2323 in education, athletics, and employment;
2424 (6) biological differences between the sexes are
2525 enduring and may, in some circumstances, warrant the creation of
2626 separate social, educational, athletic, or other spaces in order to
2727 ensure individuals' safety and allow members of each sex to succeed
2828 and thrive;
2929 (7) inconsistencies in court rulings and policy
3030 initiatives with regard to the definitions of "sex," "male,"
3131 "female," "man," and "woman" have led to endangerment of single-sex
3232 spaces and resources, necessitating clarification of certain
3333 terms;
3434 (8) in the context of biological sex:
3535 (A) "equal" does not mean "same" or "identical";
3636 and
3737 (B) separate is not inherently unequal;
3838 (9) there are legitimate reasons to distinguish
3939 between the sexes with respect to athletics, prisons and other
4040 correctional facilities, domestic violence shelters, rape crisis
4141 centers, locker rooms, restrooms, and other areas where biology,
4242 safety, or privacy are implicated; and
4343 (10) policies and laws that distinguish between the
4444 sexes are subject to intermediate constitutional scrutiny, which
4545 forbids unfair discrimination against similarly situated males and
4646 females but allows the law to distinguish between the sexes where
4747 such distinctions are substantially related to important
4848 governmental objectives.
4949 SECTION 2. Section 311.005, Government Code, is amended by
5050 adding Subdivisions (14), (15), (16), (17), (18), (19), and (20) to
5151 read as follows:
5252 (14) "Boy" means a child of the male sex.
5353 (15) "Father" means a parent of the male sex.
5454 (16) "Female" and "woman" mean an individual whose
5555 biological reproductive system is developed to produce ova.
5656 (17) "Girl" means a child of the female sex.
5757 (18) "Male" and "man" mean an individual whose
5858 biological reproductive system is developed to fertilize the ova of
5959 a female.
6060 (19) "Mother" means a parent of the female sex.
6161 (20) "Sex" means a person's biological sex, either
6262 male or female.
6363 SECTION 3. Chapter 2051, Government Code, is amended by
6464 adding Subchapter G to read as follows:
6565 SUBCHAPTER G. VITAL STATISTICS INFORMATION COLLECTION BY
6666 GOVERNMENTAL ENTITY
6767 Sec. 2051.251. DEFINITION. In this subchapter,
6868 "governmental entity" has the meaning assigned by Section 2051.041.
6969 Sec. 2051.252. VITAL STATISTICS INFORMATION COLLECTION BY
7070 GOVERNMENTAL ENTITY. A governmental entity that collects vital
7171 statistics information that identifies the biological sex of an
7272 individual for the purpose of complying with antidiscrimination
7373 laws or for the purpose of gathering public health, crime,
7474 economic, or other data shall identify each individual as either
7575 male or female.
7676 SECTION 4. This Act takes effect September 1, 2023.
