55 AN ACT
66 relating to the regulation and management of produced water from
77 oil and gas operations.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 91.101(a), Natural Resources Code, as
1010 effective until delegation of authority under the Resource
1111 Conservation and Recovery Act of 1976 (42 U.S.C. Section 6901 et
1212 seq.) to the Railroad Commission of Texas, is amended to read as
1313 follows:
1414 (a) To prevent pollution of surface water or subsurface
1515 water in the state, the commission shall adopt and enforce rules and
1616 orders and may issue permits relating to:
1717 (1) the drilling of exploratory wells and oil and gas
1818 wells or any purpose in connection with them;
1919 (2) the production of oil and gas, including:
2020 (A) activities associated with the drilling of
2121 injection water source wells which penetrate the base of useable
2222 quality water;
2323 (B) activities associated with the drilling of
2424 cathodic protection holes associated with the cathodic protection
2525 of wells and pipelines subject to the jurisdiction of the
2626 commission;
2727 (C) activities associated with gasoline plants,
2828 natural gas or natural gas liquids processing plants, pressure
2929 maintenance plants, or repressurizing plants;
3030 (D) activities associated with any underground
3131 natural gas storage facility, provided the terms "natural gas" and
3232 "storage facility" shall have the meanings set out in Section
3333 91.173, Natural Resources Code;
3434 (E) activities associated with any underground
3535 hydrocarbon storage facility, provided the terms "hydrocarbons"
3636 and "underground hydrocarbon storage facility" shall have the
3737 meanings set out in Section 91.201, Natural Resources Code; and
3838 (F) activities associated with the storage,
3939 handling, reclamation, gathering, transportation, or distribution
4040 of oil or gas prior to the refining of such oil or prior to the use
4141 of such gas in any manufacturing process or as a residential or
4242 industrial fuel;
4343 (3) the operation, abandonment, and proper plugging of
4444 wells subject to the jurisdiction of the commission; [and]
4545 (4) the discharge, storage, handling, transportation,
4646 reclamation, or disposal of oil and gas waste as defined in Section
4747 91.1011 of this subchapter, or of any other substance or material
4848 associated with any operation or activity regulated by the
4949 commission under Subdivisions (1), (2), and (3) of this subsection;
5050 and
5151 (5) the recycling and beneficial use of produced water
5252 associated with any operation or activity regulated by the
5353 commission under Subdivisions (1), (2), and (3) of this subsection,
5454 taking into account the need to protect the public health and the
5555 environment.
5656 SECTION 2. Section 91.101, Natural Resources Code, as
5757 effective on delegation of authority under the Resource
5858 Conservation and Recovery Act of 1976 (42 U.S.C. Section 6901 et
5959 seq.) to the Railroad Commission of Texas, is amended to read as
6060 follows:
6161 Sec. 91.101. RULES AND ORDERS. To prevent pollution of
6262 surface water or subsurface water in the state, the commission
6363 shall adopt and enforce rules and orders and may issue permits
6464 relating to:
6565 (1) the drilling of exploratory wells and oil and gas
6666 wells or any purpose in connection with them;
6767 (2) the production of oil and gas, including:
6868 (A) activities associated with the drilling of
6969 injection water source wells which penetrate the base of useable
7070 quality water;
7171 (B) activities associated with the drilling of
7272 cathodic protection holes associated with the cathodic protection
7373 of wells and pipelines subject to the jurisdiction of the
7474 commission;
7575 (C) activities associated with gasoline plants,
7676 natural gas or natural gas liquids processing plants, pressure
7777 maintenance plants, or repressurizing plants;
7878 (D) activities associated with any underground
7979 natural gas storage facility, provided the terms "natural gas" and
8080 "storage facility" shall have the meanings set out in Section
8181 91.173, Natural Resources Code;
8282 (E) activities associated with any underground
8383 hydrocarbon storage facility, provided the terms "hydrocarbons"
8484 and "underground hydrocarbon storage facility" shall have the
8585 meanings set out in Section 91.201, Natural Resources Code; and
8686 (F) activities associated with the storage,
8787 handling, reclamation, gathering, transportation, or distribution
8888 of oil or gas prior to the refining of such oil or prior to the use
8989 of such gas in any manufacturing process or as a residential or
9090 industrial fuel;
9191 (3) the operation, abandonment, and proper plugging of
9292 wells subject to the jurisdiction of the commission; [and]
9393 (4) the discharge, storage, handling, transportation,
9494 reclamation, or disposal of oil and gas waste as defined in Section
9595 91.1011 of this subchapter, or of any other substance or material
9696 associated with any operation or activity regulated by the
9797 commission under Subdivisions (1), (2), and (3) of this section;
9898 and
9999 (5) the recycling and beneficial use of produced water
100100 associated with any operation or activity regulated by the
101101 commission under Subdivisions (1), (2), and (3) of this section,
102102 taking into account the need to protect the public health and the
103103 environment.
104104 SECTION 3. Subtitle D, Title 3, Natural Resources Code, is
105105 amended by adding Chapter 122A to read as follows:
106106 CHAPTER 122A. BENEFICIAL USE OF PRODUCED WATER
107107 Sec. 122A.0101. BENEFICIAL USE. For the purposes of this
108108 chapter, a beneficial use of produced water means irrigation, a
109109 discharge approved under a permit issued by the Texas Commission on
110110 Environmental Quality under Chapter 26, Water Code, or another
111111 beneficial use approved under a permit issued by the Railroad
112112 Commission of Texas under Chapter 91.
113113 SECTION 4. Section 26.131(d), Water Code, as effective
114114 until delegation of authority under the Resource Conservation and
115115 Recovery Act of 1976 (42 U.S.C. Section 6901 et seq.) to the
116116 Railroad Commission of Texas, is amended to read as follows:
117117 (d) The commission may issue permits for the discharge into
118118 water in this state of produced water, hydrostatic test water, and
119119 gas plant effluent resulting from the activities described by
120120 Subsection (a) on delegation to the commission of NPDES authority
121121 for those discharges. The discharge of produced water, hydrostatic
122122 test water, and gas plant effluent into water in this state under
123123 this subsection must meet the water quality standards established
124124 by the commission. The commission shall provide to an applicant for
125125 a permit described by this subsection for the discharge of produced
126126 water assistance with the preparation and submission of the permit
127127 application.
128128 SECTION 5. Section 26.131(c), Water Code, as effective on
129129 delegation of authority under the Resource Conservation and
130130 Recovery Act of 1976 (42 U.S.C. Section 6901 et seq.) to the
131131 Railroad Commission of Texas, is amended to read as follows:
132132 (c) The commission may issue permits for the discharge into
133133 water in this state of produced water, hydrostatic test water, and
134134 gas plant effluent resulting from the activities described by
135135 Subsection (a) on delegation to the commission of NPDES authority
136136 for those discharges. The discharge of produced water, hydrostatic
137137 test water, and gas plant effluent into water in this state under
138138 this subsection must meet the water quality standards established
139139 by the commission. The commission shall provide to an applicant for
140140 a permit described by this subsection for the discharge of produced
141141 water assistance with the preparation and submission of the permit
142142 application.
143143 SECTION 6. The change in law made by this Act does not
144144 affect tax liability accruing before the effective date of this
145145 Act. That liability continues in effect as if this Act had not been
146146 enacted, and the former law is continued in effect for the
147147 collection of taxes due and for civil and criminal enforcement of
148148 the liability for those taxes.
149149 SECTION 7. This Act takes effect September 1, 2023.
