77 relating to the establishment of the office of the medical examiner

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1, Article 49.25, Code of Criminal
1111 Procedure, is amended to read as follows:
1212 Sec. 1. OFFICE AUTHORIZED. Subject to the provisions of
1313 this article, the commissioners court of any county having a
1414 population of more than one [two] million shall establish and
1515 maintain the office of medical examiner, and the commissioners
1616 court of any county may establish and provide for the maintenance of
1717 the office of medical examiner. Population shall be according to
1818 the last preceding federal census.
1919 SECTION 2. Section 1-a(a), Article 49.25, Code of Criminal
2020 Procedure, is amended to read as follows:
2121 (a) The commissioners courts of two or more counties may
2222 enter into an agreement to create a medical examiners district and
2323 to jointly operate and maintain the office of medical examiner of
2424 the district. The district must include the entire area of all
2525 counties involved. The counties within the district must, when
2626 taken together, form a continuous area. This subsection does not
2727 establish any minimum population requirement for a multi-county
2828 district created under this section.
2929 SECTION 3. This Act takes effect September 1, 2023.
