 A BILL TO BE ENTITLED
 AN ACT
 relating to the establishment of service credit in the Teacher
 Retirement System of Texas for certain military service.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 823.301(a), Government Code, is amended
 to read as follows:
 (a)  Military [Except as provided by Section 823.101(2),
 military] service creditable in the retirement system is:
 (1)  active federal duty in the armed forces of the
 United States, other than as a student at a service academy, that
 was performed:
 (A) [(1)]  as a direct result of being inducted or
 of first enlisting for duty on a date when the federal government
 was actively inducting persons into the armed forces under federal
 draft laws;
 (B) [(2)]  as a reservist or member of the
 national guard who was ordered to duty under the authority of
 federal law;
 (C) [(3)]  during a time when the federal
 government was actively inducting persons into the armed forces
 under federal draft laws; or
 (D) [(4)]  as a result of voluntarily entering on
 active duty; or
 (2)  active military service, as defined by Section
 437.001, in the Texas National Guard.
 SECTION 2.  Section 823.301(a), Government Code, as amended
 by this Act, applies only to a member of the Teacher Retirement
 System of Texas who retires on or after the effective date of this
 Act.
 SECTION 3.  This Act takes effect September 1, 2023.
