| 7 | 7 | | relating to the establishment of service credit in the Teacher |

| 8 | 8 | | Retirement System of Texas for certain military service. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 823.301(a), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) Military [Except as provided by Section 823.101(2), |
|---|
| 13 | 13 | | military] service creditable in the retirement system is: |
|---|
| 14 | 14 | | (1) active federal duty in the armed forces of the |
|---|
| 15 | 15 | | United States, other than as a student at a service academy, that |
|---|
| 16 | 16 | | was performed: |
|---|
| 17 | 17 | | (A) [(1)] as a direct result of being inducted or |
|---|
| 18 | 18 | | of first enlisting for duty on a date when the federal government |
|---|
| 19 | 19 | | was actively inducting persons into the armed forces under federal |
|---|
| 20 | 20 | | draft laws; |
|---|
| 21 | 21 | | (B) [(2)] as a reservist or member of the |
|---|
| 22 | 22 | | national guard who was ordered to duty under the authority of |
|---|
| 23 | 23 | | federal law; |
|---|
| 24 | 24 | | (C) [(3)] during a time when the federal |
|---|
| 25 | 25 | | government was actively inducting persons into the armed forces |
|---|
| 26 | 26 | | under federal draft laws; or |
|---|
| 27 | 27 | | (D) [(4)] as a result of voluntarily entering on |
|---|
| 28 | 28 | | active duty; or |
|---|
| 29 | 29 | | (2) active military service, as defined by Section |
|---|
| 30 | 30 | | 437.001, in the Texas National Guard. |
|---|
| 31 | 31 | | SECTION 2. Section 823.301(a), Government Code, as amended |
|---|
| 32 | 32 | | by this Act, applies only to a member of the Teacher Retirement |
|---|
| 33 | 33 | | System of Texas who retires on or after the effective date of this |
|---|
| 34 | 34 | | Act. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2023. |
