55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of money awarded from the skills development
88 fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 303.003, Labor Code, is amended by
1111 amending Subsection (b) and adding Subsection (b-3) to read as
1212 follows:
1313 (b) The skills development fund may be used by public
1414 community and technical colleges, community-based organizations,
1515 local workforce development boards, and the Texas A&M Engineering
1616 Extension Service [as start-up or emergency funds] for the
1717 following job-training purposes:
1818 (1) developing and implementing customized training
1919 programs for businesses and trade unions; and
2020 (2) sponsoring small and medium-sized business
2121 networks and consortiums.
2222 (b-3) Not more than 25 percent of the amount of a skills
2323 development fund grant awarded for a training project may be used
2424 for the purchase of any proprietary or production equipment
2525 necessary for the training project.
2626 SECTION 2. The changes in law made by this Act to Section
2727 303.003, Labor Code, apply only to a skills development fund grant
2828 awarded by the Texas Workforce Commission on or after the effective
2929 date of this Act. A skills development fund grant awarded before
3030 that date is governed by the law in effect on the date the grant was
3131 awarded, and the former law is continued in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2023.
