| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 303.003, Labor Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (b) and adding Subsection (b-3) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (b) The skills development fund may be used by public |
|---|
| 14 | 14 | | community and technical colleges, community-based organizations, |
|---|
| 15 | 15 | | local workforce development boards, and the Texas A&M Engineering |
|---|
| 16 | 16 | | Extension Service [as start-up or emergency funds] for the |
|---|
| 17 | 17 | | following job-training purposes: |
|---|
| 18 | 18 | | (1) developing and implementing customized training |
|---|
| 19 | 19 | | programs for businesses and trade unions; and |
|---|
| 20 | 20 | | (2) sponsoring small and medium-sized business |
|---|
| 21 | 21 | | networks and consortiums. |
|---|
| 22 | 22 | | (b-3) Not more than 25 percent of the amount of a skills |
|---|
| 23 | 23 | | development fund grant awarded for a training project may be used |
|---|
| 24 | 24 | | for the purchase of any proprietary or production equipment |
|---|
| 25 | 25 | | necessary for the training project. |
|---|
| 26 | 26 | | SECTION 2. The changes in law made by this Act to Section |
|---|
| 27 | 27 | | 303.003, Labor Code, apply only to a skills development fund grant |
|---|
| 28 | 28 | | awarded by the Texas Workforce Commission on or after the effective |
|---|
| 29 | 29 | | date of this Act. A skills development fund grant awarded before |
|---|
| 30 | 30 | | that date is governed by the law in effect on the date the grant was |
|---|
| 31 | 31 | | awarded, and the former law is continued in effect for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2023. |
