| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 571.003, Health and Safety Code, is |
|---|
| 14 | 14 | | amended by adding Subdivision (20-a) to read as follows: |

| 15 | 15 | | (20-a) "Psychiatrist" means a physician who is: |
|---|
| 16 | 16 | | (A) certified by the American Board of Psychiatry |
|---|
| 17 | 17 | | and Neurology; |
|---|
| 18 | 18 | | (B) eligible for board certification as a |
|---|
| 19 | 19 | | psychiatrist; or |
|---|
| 20 | 20 | | (C) enrolled in a board certification training |
|---|
| 21 | 21 | | program and is under the supervision of a psychiatrist who is board |
|---|
| 22 | 22 | | certified or eligible for certification. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
