55 relating to fentanyl abuse prevention and drug poisoning awareness
66 education in public schools.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. This Act may be cited as Tucker's Law.
99 SECTION 2. Section 28.004(c), Education Code, is amended to
1010 read as follows:
1111 (c) The local school health advisory council's duties
1212 include recommending:
1313 (1) the number of hours of instruction to be provided
1414 in:
1515 (A) health education in kindergarten through
1616 grade eight; and
1717 (B) if the school district requires health
1818 education for high school graduation, health education, including
1919 physical health education and mental health education, in grades 9
2020 through 12;
2121 (2) policies, procedures, strategies, and curriculum
2222 appropriate for specific grade levels designed to prevent physical
2323 health concerns, including obesity, cardiovascular disease, Type 2
2424 diabetes, and mental health concerns, including suicide, through
2525 coordination of:
2626 (A) health education, which must address
2727 physical health concerns and mental health concerns to ensure the
2828 integration of physical health education and mental health
2929 education;
3030 (B) physical education and physical activity;
3131 (C) nutrition services;
3232 (D) parental involvement;
3333 (E) instruction on substance abuse prevention;
3434 (F) school health services, including mental
3535 health services;
3636 (G) a comprehensive school counseling program
3737 under Section 33.005;
3838 (H) a safe and healthy school environment; and
3939 (I) school employee wellness;
4040 (3) appropriate grade levels and methods of
4141 instruction for human sexuality instruction;
4242 (4) strategies for integrating the curriculum
4343 components specified by Subdivision (2) with the following elements
4444 in a coordinated school health program for the district:
4545 (A) school health services, including physical
4646 health services and mental health services, if provided at a campus
4747 by the district or by a third party under a contract with the
4848 district;
4949 (B) a comprehensive school counseling program
5050 under Section 33.005;
5151 (C) a safe and healthy school environment; and
5252 (D) school employee wellness;
5353 (5) if feasible, joint use agreements or strategies
5454 for collaboration between the school district and community
5555 organizations or agencies;
5656 (6) strategies to increase parental awareness
5757 regarding:
5858 (A) risky behaviors and early warning signs of
5959 suicide risks and behavioral health concerns, including mental
6060 health disorders and substance use disorders; and
6161 (B) available community programs and services
6262 that address risky behaviors, suicide risks, and behavioral health
6363 concerns;
6464 (7) appropriate grade levels and curriculum for
6565 instruction regarding the dangers of opioids, including
6666 instruction on:
6767 (A) opioid addiction and abuse, including
6868 addiction to and abuse of synthetic opioids such as fentanyl; and
6969 (B) methods of administering an opioid
7070 antagonist, as defined by Section 483.101, Health and Safety Code;
7171 and
7272 (8) appropriate grade levels and curriculum for
7373 instruction regarding child abuse, family violence, dating
7474 violence, and sex trafficking, including likely warning signs that
7575 a child may be at risk for sex trafficking, provided that the local
7676 school health advisory council's recommendations under this
7777 subdivision do not conflict with the essential knowledge and skills
7878 developed by the State Board of Education under this subchapter.
7979 SECTION 3. Subchapter Z, Chapter 29, Education Code, is
8080 amended by adding Section 29.9074 to read as follows:
8181 Sec. 29.9074. FENTANYL POISONING AWARENESS WEEK. (a) To
8282 educate students about the dangers posed by the drug fentanyl and
8383 the risks of fentanyl poisoning, including overdose, the governor
8484 shall designate a week to be known as Fentanyl Poisoning Awareness
8585 Week in public schools.
8686 (b) Fentanyl Poisoning Awareness Week may include
8787 age-appropriate instruction, including instruction on the
8888 prevention of the abuse of and addiction to fentanyl, as determined
8989 by each school district.
9090 SECTION 4. Subchapter A, Chapter 38, Education Code, is
9191 amended by adding Section 38.040 to read as follows:
9292 Sec. 38.040. FENTANYL ABUSE PREVENTION AND DRUG POISONING
9393 AWARENESS EDUCATION. (a) Each school district shall annually
9494 provide research-based instruction related to fentanyl abuse
9595 prevention and drug poisoning awareness to students in grades 6
9696 through 12.
9797 (b) The instruction required by this section must include:
9898 (1) suicide prevention;
9999 (2) prevention of the abuse of and addiction to
100100 fentanyl;
101101 (3) awareness of local school and community resources
102102 and any processes involved in accessing those resources; and
103103 (4) health education that includes information about
104104 substance use and abuse, including youth substance use and abuse.
105105 (c) The instruction required by this section may be provided
106106 by an entity or an employee or agent of an entity that is:
107107 (1) a public or private institution of higher
108108 education;
109109 (2) a library;
110110 (3) a community service organization;
111111 (4) a religious organization;
112112 (5) a local public health agency; or
113113 (6) an organization employing mental health
114114 professionals.
115115 SECTION 5. Section 38.351, Education Code, is amended by
116116 adding Subsection (g-1) to read as follows:
117117 (g-1) A school district may satisfy a requirement to
118118 implement a program in the area of substance abuse prevention and
119119 intervention by providing instruction related to youth substance
120120 use and abuse education under Section 38.040.
121121 SECTION 6. This Act applies beginning with the 2023-2024
122122 school year.
123123 SECTION 7. This Act takes effect immediately if it receives
124124 a vote of two-thirds of all the members elected to each house, as
125125 provided by Section 39, Article III, Texas Constitution. If this
126126 Act does not receive the vote necessary for immediate effect, this
127127 Act takes effect September 1, 2023.
