55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of health benefit plan cost-sharing
88 requirements for prescription insulin.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 1358.101(a) and (c), Insurance Code,
1111 are amended to read as follows:
1212 (a) This subchapter applies only to a health benefit plan
1313 that provides benefits for medical or surgical expenses incurred as
1414 a result of a health condition, accident, or sickness, including an
1515 individual, group, blanket, or franchise insurance policy or
1616 insurance agreement, a group hospital service contract, or a small
1717 or large employer group contract or similar coverage document that
1818 is offered by:
1919 (1) an insurance company;
2020 (2) a group hospital service corporation operating
2121 under Chapter 842;
2222 (3) a fraternal benefit society operating under
2323 Chapter 885;
2424 (4) a stipulated premium company operating under
2525 Chapter 884;
2626 (5) a reciprocal exchange operating under Chapter 942;
2727 (6) a health maintenance organization operating under
2828 Chapter 843;
2929 (7) a multiple employer welfare arrangement that holds
3030 a certificate of authority under Chapter 846; [or]
3131 (8) an approved nonprofit health corporation that
3232 holds a certificate of authority under Chapter 844; or
3333 (9) a Lloyd's plan operating under Chapter 941.
3434 (c) Notwithstanding any provision in Chapter 1551, 1575,
3535 1579, or 1601 or any other law, this subchapter applies to:
3636 (1) a small employer health benefit plan subject to
3737 Chapter 1501, including coverage provided through a health group
3838 cooperative under Subchapter B of that chapter;
3939 (2) a standard health benefit plan issued under
4040 Chapter 1507;
4141 (3) a basic coverage plan under Chapter 1551;
4242 (4) [(2)] a basic plan under Chapter 1575;
4343 (5) [(3)] a primary care coverage plan under Chapter
4444 1579; [and]
4545 (6) [(4)] basic coverage under Chapter 1601;
4646 (7) nonprofit agricultural organization health
4747 benefits offered by a nonprofit agricultural organization under
4848 Chapter 1682;
4949 (8) alternative health benefit coverage offered by a
5050 subsidiary of the Texas Mutual Insurance Company under Subchapter
5151 M, Chapter 2054;
5252 (9) health benefits provided by or through a church
5353 benefits board under Subchapter I, Chapter 22, Business
5454 Organizations Code;
5555 (10) a regional or local health care program operated
5656 under Section 75.104, Health and Safety Code;
5757 (11) a self-funded health benefit plan sponsored by a
5858 professional employer organization under Chapter 91, Labor Code;
5959 (12) county employee group health benefits provided
6060 under Chapter 157, Local Government Code; and
6161 (13) health and accident coverage provided by a risk
6262 pool created under Chapter 172, Local Government Code.
6363 SECTION 2. Section 1358.102, Insurance Code, is amended to
6464 read as follows:
6565 Sec. 1358.102. EXCEPTION. This subchapter does not apply
6666 to:
6767 (1) a health benefit plan that provides coverage:
6868 (A) only for a specified disease or for another
6969 single benefit;
7070 (B) only for accidental death or dismemberment;
7171 (C) for wages or payments in lieu of wages for a
7272 period during which an employee is absent from work because of
7373 sickness or injury;
7474 (D) as a supplement to a liability insurance
7575 policy;
7676 (E) for credit insurance;
7777 (F) only for dental or vision care;
7878 (G) only for hospital expenses; or
7979 (H) only for indemnity for hospital confinement;
8080 (2) a Medicare supplemental policy as defined by
8181 Section 1882(g)(1), Social Security Act (42 U.S.C. Section 1395ss);
8282 (3) medical payment insurance coverage provided under
8383 a motor vehicle insurance policy;
8484 (4) a long-term care insurance policy, including a
8585 nursing home fixed indemnity policy, unless the commissioner
8686 determines that the policy provides benefit coverage so
8787 comprehensive that the policy is a health benefit plan as described
8888 by Section 1358.101; or
8989 (5) [health and accident coverage provided by a risk
9090 pool created under Chapter 172, Local Government Code; or
9191 [(6)] a workers' compensation insurance policy.
9292 SECTION 3. The changes in law made by this Act apply only to
9393 a health benefit plan that is delivered, issued for delivery, or
9494 renewed on or after January 1, 2024. A health benefit plan
9595 delivered, issued for delivery, or renewed before January 1, 2024,
9696 is governed by the law as it existed immediately before the
9797 effective date of this Act, and that law is continued in effect for
9898 that purpose.
9999 SECTION 4. This Act takes effect September 1, 2023.
