| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 254.001(1) and (5), Health and Safety |
|---|
| 11 | 11 | | Code, are amended to read as follows: |
|---|
| 12 | 12 | | (1) "Acute care services" means outpatient medical |
|---|
| 13 | 13 | | services, including radiology services, laboratory services, |
|---|
| 14 | 14 | | immunization services, and other non-emergent physician services |
|---|
| 15 | 15 | | ["Department" means the Department of State Health Services]. |
|---|
| 16 | 16 | | (5) "Freestanding emergency medical care facility" |
|---|
| 17 | 17 | | means a facility, structurally separate and distinct from a |
|---|
| 18 | 18 | | hospital, that receives an individual and provides: |
|---|
| 19 | 19 | | (A) emergency care, as defined by Subdivision |
|---|
| 20 | 20 | | (2); and |
|---|
| 21 | 21 | | (B) acute care services, as defined by |
|---|
| 22 | 22 | | Subdivision (1). |

| 23 | 23 | | SECTION 2. Subchapter A, Chapter 254, Health and Safety |
|---|
| 24 | 24 | | Code, is amended by adding Section 254.002 to read as follows: |
|---|
| 25 | 25 | | Sec. 254.002. REFERENCE IN LAW. A reference in this chapter |
|---|
| 26 | 26 | | to "department" means the Health and Human Services Commission. |
|---|
| 27 | 27 | | SECTION 3. Section 254.1555, Health and Safety Code, is |
|---|
| 28 | 28 | | amended by adding Subsection (a-1) to read as follows: |
|---|
| 29 | 29 | | (a-1) A facility that provides acute care services may not |
|---|
| 30 | 30 | | charge an emergency facility fee for providing the services. |
|---|
| 31 | 31 | | SECTION 4. This Act takes effect September 1, 2023. |
