55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to services provided by freestanding emergency medical
88 care facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 254.001(1) and (5), Health and Safety
1111 Code, are amended to read as follows:
1212 (1) "Acute care services" means outpatient medical
1313 services, including radiology services, laboratory services,
1414 immunization services, and other non-emergent physician services
1515 ["Department" means the Department of State Health Services].
1616 (5) "Freestanding emergency medical care facility"
1717 means a facility, structurally separate and distinct from a
1818 hospital, that receives an individual and provides:
1919 (A) emergency care, as defined by Subdivision
2020 (2); and
2121 (B) acute care services, as defined by
2222 Subdivision (1).
2323 SECTION 2. Subchapter A, Chapter 254, Health and Safety
2424 Code, is amended by adding Section 254.002 to read as follows:
2525 Sec. 254.002. REFERENCE IN LAW. A reference in this chapter
2626 to "department" means the Health and Human Services Commission.
2727 SECTION 3. Section 254.1555, Health and Safety Code, is
2828 amended by adding Subsection (a-1) to read as follows:
2929 (a-1) A facility that provides acute care services may not
3030 charge an emergency facility fee for providing the services.
3131 SECTION 4. This Act takes effect September 1, 2023.
