| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39.159, Utilities Code, as added by |
|---|
| 11 | 11 | | Chapter 426 (S.B. 3), Acts of the 87th Legislature, Regular |
|---|
| 12 | 12 | | Session, 2021, is amended by adding Subsection (d) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (d) The commission shall ensure that any commission program |
|---|
| 15 | 15 | | adopted to comply with the requirements of this section that |
|---|
| 16 | 16 | | assigns credits to or provides for capacity payments to generation |
|---|
| 17 | 17 | | facilities includes credits or payments available to nuclear and |
|---|
| 18 | 18 | | advanced nuclear generation facilities. |
|---|
| 19 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2023. |
