77 relating to the auditing of an electric cooperative or municipally
88 owned electric utility by an independent third party auditor after
99 a power outage.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 38, Utilities Code, is
1212 amended by adding Section 38.053 to read as follows:
1313 Sec. 38.053. ELECTRIC COOPERATIVE; AUDIT REQUIRED. (a) In
1414 this section, "extended power outage" means a power outage lasting
1515 five days or more.
1616 (b) The resiliency of the system of an electric cooperative
1717 must be audited by an independent third party auditor if an extended
1818 power outage affects 10 percent or more of its retail customers.
1919 (c) The board of directors of an electric cooperative shall
2020 contract with an independent third party auditor that meets the
2121 professional certifications established by the commission under
2222 Subsection (d) to perform the audit described by Subsection (b).
2323 (d) The commission by rule shall establish the professional
2424 certifications an independent third party auditor must have to
2525 perform the audit described by Subsection (b) and the information
2626 the audit must examine.
2727 (e) After an audit under this section is completed, the
2828 electric cooperative shall make the audit report publicly
2929 available.
3030 SECTION 2. Subchapter Z, Chapter 552, Local Government
3131 Code, is amended by adding Section 552.9021 to read as follows:
3232 Sec. 552.9021. MUNICIPALLY OWNED ELECTRIC UTILITY; AUDIT
3333 REQUIRED. (a) In this section:
3434 (1) "Extended power outage" means a power outage
3535 lasting five days or more.
3636 (2) "Retail customer" has the meaning assigned by
3737 Section 31.002, Utilities Code.
3838 (b) The resiliency of a municipally owned electric utility
3939 system must be audited by an independent third party auditor if an
4040 extended power outage affects 10 percent or more of its retail
4141 customers.
4242 (c) The governing body of the municipality that owns the
4343 utility shall contract with an independent third party auditor to
4444 perform the audit described by Subsection (b).
4545 (d) The independent third party auditor must have the
4646 professional certifications required under and perform the audit in
4747 the manner required under Section 38.053(d), Utilities Code.
4848 (e) After an audit under this section is completed, the
4949 municipality that owns the utility shall make the audit report
5050 publicly available.
5151 SECTION 3. This Act takes effect September 1, 2023.
