7 | 7 | | relating to a pilot program using average enrollment for purposes |

8 | 8 | | of the public school finance system. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 48, Education Code, is |
---|
11 | 11 | | amended by adding Section 48.0052 to read as follows: |
---|
12 | 12 | | Sec. 48.0052. AVERAGE ENROLLMENT PILOT PROGRAM. (a) The |
---|
13 | 13 | | commissioner by rule shall establish a pilot program under which |
---|
14 | 14 | | participating school districts and open-enrollment charter schools |
---|
15 | 15 | | receive funding under the public school finance system based on |
---|
16 | 16 | | average enrollment instead of average daily attendance. |
---|
17 | 17 | | (b) A school district or open-enrollment charter school |
---|
18 | 18 | | must apply to participate in the pilot program. |
---|
19 | 19 | | (c) To the extent practicable, the commissioner shall |
---|
20 | 20 | | approve for participation in the pilot program: |
---|
21 | 21 | | (1) five school districts with a student enrollment as |
---|
22 | 22 | | follows: |
---|
23 | 23 | | (A) one district with a student enrollment of |
---|
24 | 24 | | 1,500 or less; |
---|
25 | 25 | | (B) one district with a student enrollment of |
---|
26 | 26 | | more than 1,500 but not more than 5,000; |
---|
27 | 27 | | (C) one district with a student enrollment of |
---|
28 | 28 | | more than 5,000 but not more than 20,000; |
---|
29 | 29 | | (D) one district with a student enrollment of |
---|
30 | 30 | | more than 20,000 but less than 50,000; and |
---|
31 | 31 | | (E) one district with a student enrollment of |
---|
32 | 32 | | 50,000 or more; and |
---|
33 | 33 | | (2) three open-enrollment charter schools of three |
---|
34 | 34 | | different sizes, as determined by the commissioner. |
---|
35 | 35 | | (d) Under the pilot program, the commissioner shall, for |
---|
36 | 36 | | each participating school district or open-enrollment charter |
---|
37 | 37 | | school, for the 2023-2024 and 2024-2025 school years: |
---|
38 | 38 | | (1) reduce by $200 the amount of the basic allotment |
---|
39 | 39 | | determined under Section 48.051 for each student enrolled in the |
---|
40 | 40 | | district or school; |
---|
41 | 41 | | (2) calculate the district's or school's entitlement |
---|
42 | 42 | | under Chapter 46 and this chapter using the average number of |
---|
43 | 43 | | students enrolled at the district or school instead of the |
---|
44 | 44 | | district's or school's average daily attendance determined under |
---|
45 | 45 | | Section 48.005; and |
---|
46 | 46 | | (3) make the payments from the foundation school fund |
---|
47 | 47 | | to the district or school under Section 48.273 in four equal amounts |
---|
48 | 48 | | on or before dates determined by commissioner rule. |
---|
49 | 49 | | (e) Not later than December 1, 2024, the commissioner shall |
---|
50 | 50 | | submit to the legislature a written report on the results of the |
---|
51 | 51 | | pilot program and any recommendations for legislative or other |
---|
52 | 52 | | action. |
---|
53 | 53 | | (f) The commissioner may adopt rules as necessary to |
---|
54 | 54 | | implement the pilot program. |
---|
55 | 55 | | (g) This section expires September 1, 2025. |
---|
56 | 56 | | SECTION 2. This Act takes effect immediately if it receives |
---|
57 | 57 | | a vote of two-thirds of all the members elected to each house, as |
---|
58 | 58 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
59 | 59 | | Act does not receive the vote necessary for immediate effect, this |
---|
60 | 60 | | Act takes effect September 1, 2023. |
