| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 29.042(a), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) The agency by rule shall establish and administer a |
|---|
| 13 | 13 | | supplemental special education services and instructional |
|---|
| 14 | 14 | | materials program for students who meet the eligibility |
|---|
| 15 | 15 | | requirements for participation in the program. The [Subject to |
|---|
| 16 | 16 | | Subsection (c), the] agency shall provide each student approved as |
|---|
| 17 | 17 | | provided by this subchapter a grant of not more than $1,500 to |
|---|
| 18 | 18 | | purchase supplemental special education services and supplemental |
|---|
| 19 | 19 | | special education instructional materials. |
|---|
| 20 | 20 | | SECTION 2. The following provisions of the Education Code |
|---|
| 21 | 21 | | are repealed: |
|---|
| 22 | 22 | | (1) Section 29.042(c); and |
|---|
| 23 | 23 | | (2) Section 29.050. |
|---|
| 24 | 24 | | SECTION 3. This Act applies beginning with the 2023-2024 |
|---|
| 25 | 25 | | school year. |
|---|
| 26 | 26 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2023. |
