66 AN ACT
77 relating to the funding and continuation of the supplemental
88 special education services and instructional materials program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.042(a), Education Code, is amended to
1111 read as follows:
1212 (a) The agency by rule shall establish and administer a
1313 supplemental special education services and instructional
1414 materials program for students who meet the eligibility
1515 requirements for participation in the program. The [Subject to
1616 Subsection (c), the] agency shall provide each student approved as
1717 provided by this subchapter a grant of not more than $1,500 to
1818 purchase supplemental special education services and supplemental
1919 special education instructional materials.
2020 SECTION 2. The following provisions of the Education Code
2121 are repealed:
2222 (1) Section 29.042(c); and
2323 (2) Section 29.050.
2424 SECTION 3. This Act applies beginning with the 2023-2024
2525 school year.
2626 SECTION 4. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2023.
