| 7 | 7 | | relating to a requirement that a public hearing be held on a |
|---|
| 8 | 8 | | proposal by the governor or the Legislative Budget Board to affect |
|---|
| 9 | 9 | | appropriations. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 317.005, Government Code, is amended by |
|---|
| 12 | 12 | | amending Subsections (a) and (b) and adding Subsection (a-1) to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (a) After a [governor's] proposal under this chapter is |
|---|
| 15 | 15 | | published in the Texas Register, the Legislative Budget Board shall |
|---|
| 16 | 16 | | [may] conduct a public hearing on the proposal. The board shall |
|---|
| 17 | 17 | | give notice of a hearing under this section in the manner provided |
|---|
| 18 | 18 | | by law for notice of regular meetings of the board. The board also |
|---|
| 19 | 19 | | shall provide notice by mail of its meetings to each member of the |
|---|
| 20 | 20 | | Legislature. The notice of the meeting must include a description |
|---|
| 21 | 21 | | of the nature of the proposal or order to be considered. [If the |
|---|
| 22 | 22 | | agenda includes a public hearing on a proposal, the notice must so |
|---|
| 23 | 23 | | state.] |
|---|
| 24 | 24 | | (a-1) After a hearing under Subsection (a) and at a meeting |
|---|
| 25 | 25 | | held not less than 10 days after the date notice of the meeting was |
|---|
| 26 | 26 | | given in the manner provided for regular board meetings, in |
|---|
| 27 | 27 | | response to a [governor's] proposal by the governor, the board, |
|---|
| 28 | 28 | | subject to the restrictions provided by Subsection (e), may: |
|---|
| 29 | 29 | | (1) ratify the proposal by adopting an order changing |
|---|
| 30 | 30 | | the relevant appropriation in the manner specified in the proposal; |
|---|
| 31 | 31 | | (2) reject the proposal; or |
|---|
| 32 | 32 | | (3) recommend changes in the proposal. |
|---|
| 33 | 33 | | (b) After a hearing under Subsection (a), in [In] response |
|---|
| 34 | 34 | | to a proposal by the board, the governor may take any action |
|---|
| 35 | 35 | | specified by Subsection (a-1) [(a)] for board action on a |
|---|
| 36 | 36 | | [governor's] proposal by the governor. |
|---|
| 37 | 37 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 38 | 38 | | to a proposal under Chapter 317, Government Code, made on or after |
|---|
| 39 | 39 | | the effective date of this Act. A proposal under Chapter 317, |
|---|
| 40 | 40 | | Government Code, made before the effective date of this Act is |
|---|
| 41 | 41 | | governed by the law in effect when the proposal was made, and the |
|---|
| 42 | 42 | | former law is continued in effect for that purpose. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2023. |
