55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a requirement that a public hearing be held on a
88 proposal by the governor or the Legislative Budget Board to affect
99 appropriations.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 317.005, Government Code, is amended by
1212 amending Subsections (a) and (b) and adding Subsection (a-1) to
1313 read as follows:
1414 (a) After a [governor's] proposal under this chapter is
1515 published in the Texas Register, the Legislative Budget Board shall
1616 [may] conduct a public hearing on the proposal. The board shall
1717 give notice of a hearing under this section in the manner provided
1818 by law for notice of regular meetings of the board. The board also
1919 shall provide notice by mail of its meetings to each member of the
2020 Legislature. The notice of the meeting must include a description
2121 of the nature of the proposal or order to be considered. [If the
2222 agenda includes a public hearing on a proposal, the notice must so
2323 state.]
2424 (a-1) After a hearing under Subsection (a) and at a meeting
2525 held not less than 10 days after the date notice of the meeting was
2626 given in the manner provided for regular board meetings, in
2727 response to a [governor's] proposal by the governor, the board,
2828 subject to the restrictions provided by Subsection (e), may:
2929 (1) ratify the proposal by adopting an order changing
3030 the relevant appropriation in the manner specified in the proposal;
3131 (2) reject the proposal; or
3232 (3) recommend changes in the proposal.
3333 (b) After a hearing under Subsection (a), in [In] response
3434 to a proposal by the board, the governor may take any action
3535 specified by Subsection (a-1) [(a)] for board action on a
3636 [governor's] proposal by the governor.
3737 SECTION 2. The change in law made by this Act applies only
3838 to a proposal under Chapter 317, Government Code, made on or after
3939 the effective date of this Act. A proposal under Chapter 317,
4040 Government Code, made before the effective date of this Act is
4141 governed by the law in effect when the proposal was made, and the
4242 former law is continued in effect for that purpose.
4343 SECTION 3. This Act takes effect September 1, 2023.
