55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the expansion of eligibility for Medicaid to certain
88 working parents for whom federal matching money is available.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. This Act may be cited as the Medicaid for Texas
1111 Working Families Act.
1212 SECTION 2. Subchapter B, Chapter 32, Human Resources Code,
1313 is amended by adding Section 32.02473 to read as follows:
1414 Sec. 32.02473. EXPANDED ELIGIBILITY FOR MEDICAL
1515 ASSISTANCE. (a) Notwithstanding any other law, the commission
1616 shall provide medical assistance to all persons:
1717 (1) who are the working parent of a dependent child;
1818 (2) who apply for the assistance; and
1919 (3) for whom federal matching money is available.
2020 (b) The executive commissioner shall adopt rules necessary
2121 to implement this section.
2222 SECTION 3. Section 32.02473, Human Resources Code, as added
2323 by this Act, applies only to an initial determination or
2424 recertification of eligibility of a person for medical assistance
2525 under Chapter 32, Human Resources Code, made on or after the date
2626 the section is implemented, regardless of the date the person
2727 applied for that assistance.
2828 SECTION 4. As soon as possible after the effective date of
2929 this Act, the executive commissioner of the Health and Human
3030 Services Commission shall take all necessary actions to expand
3131 eligibility for medical assistance under Chapter 32, Human
3232 Resources Code, in accordance with Section 32.02473, Human
3333 Resources Code, as added by this Act, including notifying
3434 appropriate federal agencies of that expanded eligibility.
3535 SECTION 5. If before implementing any provision of this Act
3636 a state agency determines that any other waiver or authorization
3737 from a federal agency is necessary for implementation of that
3838 provision, the agency affected by the provision shall request the
3939 waiver or authorization and may delay implementing that provision
4040 until the waiver or authorization is granted.
4141 SECTION 6. This Act takes effect September 1, 2023.
