| 7 | 7 | | relating to accompanying and filming peace officers of the state |

| 8 | 8 | | and local law enforcement agencies for producing a documentary |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 614.231, Government Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | Sec. 614.231. DEFINITIONS. In this subchapter: |
|---|
| 14 | 14 | | (1) "Documentary film" means a theatrically released |
|---|
| 15 | 15 | | nonfiction motion picture dealing creatively with cultural, |
|---|
| 16 | 16 | | artistic, historical, social, scientific, economic, or other |
|---|
| 17 | 17 | | subjects that may have been photographed in actual occurrence, or |
|---|
| 18 | 18 | | may employ partial reenactment, stock footage, stills, animation, |
|---|
| 19 | 19 | | stop-motion, or other techniques, as long as the emphasis is on fact |
|---|
| 20 | 20 | | and not fiction, including a series of films that may be released in |
|---|
| 21 | 21 | | several parts or episodes. |
|---|
| 22 | 22 | | (2) "Law enforcement agency" means an agency of this |
|---|
| 23 | 23 | | state or a political subdivision of this state that employs peace |
|---|
| 24 | 24 | | officers other than game wardens. |
|---|
| 25 | 25 | | (3) [(2)] "Reality television program" means a |
|---|
| 26 | 26 | | nonfictional television program that features the same live |
|---|
| 27 | 27 | | subjects over the course of more than one episode primarily for |
|---|
| 28 | 28 | | entertainment purposes, but does not include a documentary film or |
|---|
| 29 | 29 | | reporting on a matter of public concern by a journalist as defined |
|---|
| 30 | 30 | | by Article 38.11, Code of Criminal Procedure. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2023. |
