55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to accompanying and filming peace officers of the state
88 and local law enforcement agencies for producing a documentary
99 film.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 614.231, Government Code, is amended to
1212 read as follows:
1313 Sec. 614.231. DEFINITIONS. In this subchapter:
1414 (1) "Documentary film" means a theatrically released
1515 nonfiction motion picture dealing creatively with cultural,
1616 artistic, historical, social, scientific, economic, or other
1717 subjects that may have been photographed in actual occurrence, or
1818 may employ partial reenactment, stock footage, stills, animation,
1919 stop-motion, or other techniques, as long as the emphasis is on fact
2020 and not fiction, including a series of films that may be released in
2121 several parts or episodes.
2222 (2) "Law enforcement agency" means an agency of this
2323 state or a political subdivision of this state that employs peace
2424 officers other than game wardens.
2525 (3) [(2)] "Reality television program" means a
2626 nonfictional television program that features the same live
2727 subjects over the course of more than one episode primarily for
2828 entertainment purposes, but does not include a documentary film or
2929 reporting on a matter of public concern by a journalist as defined
3030 by Article 38.11, Code of Criminal Procedure.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2023.
