55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a financial report filed by an open-enrollment charter
88 school.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12.1168(b), Education Code, is amended
1111 to read as follows:
1212 (b) A financial report filed under Section 44.008 by an
1313 open-enrollment charter school must separately disclose:
1414 (1) each [all] financial transaction [transactions]
1515 between the open-enrollment charter school and any related party,
1616 separately stating the:
1717 (A) relationship;
1818 (B) address;
1919 (C) principal;
2020 (D) [,] interest;
2121 (E) annual and total contract payments including
2222 a description of goods or services; [,] and
2323 (F) annual and total lease payments including a
2424 description of the property; [and]
2525 (2) the total compensation and benefits provided by
2626 the school and any related party for each member of the governing
2727 body and each officer and administrator of the school and the
2828 related party;
2929 (3) the name and address of any management company;
3030 and
3131 (4) fees paid during each of the preceding three years
3232 to a management company or to any related party for each good,
3333 service, or item, including:
3434 (A) management services;
3535 (B) branding or licensing;
3636 (C) advertising;
3737 (D) student recruitment;
3838 (E) instructional costs including curriculum and
3939 professional development;
4040 (F) facility development;
4141 (G) student uniforms; and
4242 (H) teacher salaries.
4343 SECTION 2. Section 44.008(f), Education Code, is amended to
4444 read as follows:
4545 (f) An open-enrollment charter school shall provide an
4646 accounting of each parcel of the school's owned or leased real
4747 property, including identifying the:
4848 (1) address;
4949 (2) owner;
5050 (3) purpose and use of each parcel;
5151 (4) name of each campus listed; and
5252 (5) annual and total amount of local, state, and
5353 federal funds used to purchase, lease, or improve each parcel of
5454 property.
5555 SECTION 3. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2023.
