55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the payment for liquor by a wholesaler.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 102.31(a), Alcoholic Beverage Code, is
1010 amended to read as follows:
1111 (a) This section applies to:
1212 (1) the sale of malt beverages or malt beverage
1313 containers or the original packages in which malt beverages are
1414 received, packaged, or contained by a distributor's licensee to a
1515 retail dealer's on-premise or off-premise licensee, a wine and malt
1616 beverage retailer's permittee, or a wine and malt beverage
1717 retailer's off-premise permittee; [and]
1818 (2) the sale of malt beverages by a local distributor's
1919 permittee, or by any licensee authorized to sell those beverages
2020 for resale, to a mixed beverage permittee;
2121 (3) the sale of liquor by a distiller's and rectifier's
2222 permittee, winery permittee, rectifier who is a nonresident
2323 seller's permittee, or by any permittee authorized to sell those
2424 beverages for resale to a wholesaler's permittee;
2525 (4) the sale of vinous liquors by a distiller's and
2626 rectifier's permittee, winery permittee, wine manufacturer who is a
2727 nonresident seller's permittee, or by any permittee authorized to
2828 sell those beverages for resale to a class B wholesaler permittee;
2929 and
3030 (5) the sale of liquor by any permittee authorized to
3131 sell those beverages for resale to a local distributor's permittee.
3232 SECTION 2. This Act takes effect September 1, 2023.
