| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 408, Labor Code, is |

| 14 | 14 | | amended by adding Section 408.0011 to read as follows: |

| 15 | 15 | | Sec. 408.0011. CIVIL ACTION FOR INJURIES SUSTAINED BY |
|---|
| 16 | 16 | | VICTIM OF SEXUAL ASSAULT. (a) Notwithstanding Section 408.001, an |
|---|
| 17 | 17 | | employee who is the victim of sexual assault may bring a cause of |
|---|
| 18 | 18 | | action against the employer if the employee's injuries arose from |
|---|
| 19 | 19 | | the employer's gross negligence. |
|---|
| 20 | 20 | | (b) In this section, "sexual assault" means conduct |
|---|
| 21 | 21 | | described by Section 22.011 or 22.021, Penal Code. |

| 22 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 23 | 23 | | to a cause of action that accrues on or after the effective date of |
|---|
| 24 | 24 | | this Act. |

| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2023. |
