88 AN ACT
99 relating to an employer's civil liability under the Texas Workers'
1010 Compensation Act for injuries sustained by a victim of sexual
1111 assault.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 408, Labor Code, is
1414 amended by adding Section 408.0011 to read as follows:
1515 Sec. 408.0011. CIVIL ACTION FOR INJURIES SUSTAINED BY
1616 VICTIM OF SEXUAL ASSAULT. (a) Notwithstanding Section 408.001, an
1717 employee who is the victim of sexual assault may bring a cause of
1818 action against the employer if the employee's injuries arose from
1919 the employer's gross negligence.
2020 (b) In this section, "sexual assault" means conduct
2121 described by Section 22.011 or 22.021, Penal Code.
2222 SECTION 2. The change in law made by this Act applies only
2323 to a cause of action that accrues on or after the effective date of
2424 this Act.
2525 SECTION 3. This Act takes effect September 1, 2023.
