5	5	relating to the designation of certain fire marshals and related
6	6	officers, inspectors, and investigators as peace officers.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Article 2.12, Code of Criminal Procedure, is
9	9	amended to read as follows:
10	10	Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
11	11	officers:
12	12	(1) sheriffs, their deputies, and those reserve
13	13	deputies who hold a permanent peace officer license issued under
14	14	Chapter 1701, Occupations Code;
15	15	(2) constables, deputy constables, and those reserve
16	16	deputy constables who hold a permanent peace officer license issued
17	17	under Chapter 1701, Occupations Code;
18	18	(3) marshals or police officers of an incorporated
19	19	city, town, or village, and those reserve municipal police officers
20	20	who hold a permanent peace officer license issued under Chapter
21	21	1701, Occupations Code;
22	22	(4) rangers, officers, and members of the reserve
23	23	officer corps commissioned by the Public Safety Commission and the
24	24	Director of the Department of Public Safety;
25	25	(5) investigators of the district attorneys', criminal
26	26	district attorneys', and county attorneys' offices;
27	27	(6) law enforcement agents of the Texas Alcoholic
28	28	Beverage Commission;
29	29	(7) each member of an arson investigating unit
30	30	commissioned by a city, a county, or the state;
31	31	(8) officers commissioned under Section 37.081,
32	32	Education Code, or Subchapter E, Chapter 51, Education Code;
33	33	(9) officers commissioned by the General Services
34	34	Commission;
35	35	(10) law enforcement officers commissioned by the
36	36	Parks and Wildlife Commission;
37	37	(11) officers commissioned under Chapter 23,
38	38	Transportation Code;
39	39	(12) municipal park and recreational patrolmen and
40	40	security officers;
41	41	(13) security officers and investigators commissioned
42	42	as peace officers by the comptroller;
43	43	(14) officers commissioned by a water control and
44	44	improvement district under Section 49.216, Water Code;
45	45	(15) officers commissioned by a board of trustees
46	46	under Chapter 54, Transportation Code;
47	47	(16) investigators commissioned by the Texas Medical
48	48	Board;
49	49	(17) officers commissioned by:
50	50	(A) the board of managers of the Dallas County
51	51	Hospital District, the Tarrant County Hospital District, the Bexar
52	52	County Hospital District, or the El Paso County Hospital District
53	53	under Section 281.057, Health and Safety Code;
54	54	(B) the board of directors of the Ector County
55	55	Hospital District under Section 1024.117, Special District Local
56	56	Laws Code;
57	57	(C) the board of directors of the Midland County
58	58	Hospital District of Midland County, Texas, under Section 1061.121,
59	59	Special District Local Laws Code; and
60	60	(D) the board of hospital managers of the Lubbock
61	61	County Hospital District of Lubbock County, Texas, under Section
62	62	1053.113, Special District Local Laws Code;
63	63	(18) county park rangers commissioned under
64	64	Subchapter E, Chapter 351, Local Government Code;
65	65	(19) investigators employed by the Texas Racing
66	66	Commission;
67	67	(20) officers commissioned under Chapter 554,
68	68	Occupations Code;
69	69	(21) officers commissioned by the governing body of a
70	70	metropolitan rapid transit authority under Section 451.108,
71	71	Transportation Code, or by a regional transportation authority
72	72	under Section 452.110, Transportation Code;
73	73	(22) investigators commissioned by the attorney
74	74	general under Section 402.009, Government Code;
75	75	(23) security officers and investigators commissioned
76	76	as peace officers under Chapter 466, Government Code;
77	77	(24) officers appointed by an appellate court under
78	78	Subchapter F, Chapter 53, Government Code;
79	79	(25) officers commissioned by the state fire marshal
80	80	under Chapter 417, Government Code;
81	81	(26) an investigator commissioned by the commissioner
82	82	of insurance under Section 701.104, Insurance Code;
83	83	(27) apprehension specialists and inspectors general
84	84	commissioned by the Texas Juvenile Justice Department as officers
85	85	under Sections 242.102 and 243.052, Human Resources Code;
86	86	(28) officers appointed by the inspector general of
87	87	the Texas Department of Criminal Justice under Section 493.019,
88	88	Government Code;
89	89	(29) investigators commissioned by the Texas
90	90	Commission on Law Enforcement under Section 1701.160, Occupations
91	91	Code;
92	92	(30) commission investigators commissioned by the
93	93	Texas Private Security Board under Section 1702.061, Occupations
94	94	Code;
95	95	(31) the fire marshal and any officers, inspectors, or
96	96	investigators commissioned by an emergency services district under
97	97	Chapter 775, Health and Safety Code;
98	98	(32) officers commissioned by the State Board of
99	99	Dental Examiners under Section 254.013, Occupations Code, subject
100	100	to the limitations imposed by that section;
101	101	(33) investigators commissioned by the Texas Juvenile
102	102	Justice Department as officers under Section 221.011, Human
103	103	Resources Code; [and]
104	104	(34) the fire marshal and any related officers,
105	105	inspectors, or investigators commissioned by a county under
106	106	Subchapter B, Chapter 352, Local Government Code; and
107	107	(35) fire marshals and any related officers,
108	108	inspectors, or investigators of a municipality who hold a permanent
109	109	peace officer license issued under Chapter 1701, Occupations Code.
110	110	SECTION 2. This Act takes effect September 1, 2023.
