77 relating to notice and safety requirements applicable to certain
88 LP-Gas containers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 113, Natural Resources
1111 Code, is amended by adding Section 113.085 to read as follows:
1212 Sec. 113.085. NOTICE OF INTENT TO OBTAIN PERMIT OR PERMIT
1313 REVIEW; HEARING. (a) For a proposed installation or modification
1414 of an LP-gas container located at a bulk storage terminal, as
1515 defined by Section 26.3442, Water Code, the commission shall
1616 require the applicant to mail a notice to:
1717 (1) all owners of real property located 150 yards or
1818 less from the location of the proposed installation or modification
1919 activities; and
2020 (2) the state representative of the state legislative
2121 district in which the installation or modification activities are
2222 proposed to be performed.
2323 (b) The notice must:
2424 (1) contain information about the proposed
2525 installation or modification activities as required by the
2626 commission; and
2727 (2) be sent by registered or certified mail, return
2828 receipt requested, or by another form of mail that provides proof of
2929 delivery.
3030 (c) A person who resides in a residence located 150 yards or
3131 less from the location of the proposed installation or modification
3232 activities may request that the commission, in cooperation with the
3333 applicant, hold a public hearing in the county in which the
3434 installation or modification activities are proposed to be
3535 performed to:
3636 (1) inform the public about the application; and
3737 (2) obtain public input regarding the application.
3838 SECTION 2. Chapter 113, Natural Resources Code, is amended
3939 by adding Subchapter N to read as follows:
4040 SUBCHAPTER N. SAFETY STANDARDS FOR CERTAIN LP-GAS CONTAINERS
4141 Sec. 113.451. APPLICABILITY. This subchapter applies only
4242 to an LP-gas container located at a bulk storage terminal as defined
4343 by Section 26.3442, Water Code.
4444 Sec. 113.452. LEAK DETECTION AND REPAIR PROTOCOL. The
4545 commission shall establish a leak detection and repair protocol to
4646 protect a surrounding community from the release of substances from
4747 an LP-gas container at a bulk storage terminal in the event of an
4848 accident or natural disaster. The protocol must include:
4949 (1) periodic monitoring of each LP-gas container to
5050 identify any leaks or necessary repairs; and
5151 (2) identification of a public notification system the
5252 facility may use to notify persons who reside 150 yards or less from
5353 the LP-gas container of an emergency.
5454 Sec. 113.453. RISK MANAGEMENT PLAN. A license holder that
5555 operates an LP-gas container at a bulk storage terminal shall
5656 develop a risk management plan and post the risk management plan on
5757 the facility's publicly available Internet website.
5858 Sec. 113.454. EMERGENCY RESPONSE PLAN. A license holder
5959 that operates an LP-gas container at a bulk storage terminal shall
6060 develop an emergency response plan. The emergency response plan
6161 must:
6262 (1) identify the person to notify in the event of an
6363 emergency;
6464 (2) describe the types of incidents for which the fire
6565 department must be notified, including leaks, fire, or damage to an
6666 LP-gas container; and
6767 (3) describe the method by which the community will be
6868 notified of an emergency.
6969 Sec. 113.455. COMMUNITY OUTREACH. A license holder that
7070 operates an LP-gas container at a bulk storage terminal shall
7171 provide to persons who reside 150 yards or less from the LP-gas
7272 container:
7373 (1) annual updates regarding the status of the
7474 container; and
7575 (2) information regarding safety protocols to be
7676 followed in an emergency.
7777 SECTION 3. This Act takes effect September 1, 2023.
