66 AN ACT
77 relating to the identification of certain student behavior by a
88 school district's threat assessment and safe and supportive school
99 team.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 37.115(a), (b), and (f), Education
1212 Code, are amended to read as follows:
1313 (a) In this section:
1414 (1) "Early behavior" includes behaviors, such as a
1515 change in attendance, academic performance, or emotional response,
1616 the exhibition of withdrawn behavior or early signs of self-harm,
1717 problematic peer interaction, or a discipline concern, by a student
1818 that could result in or benefit from:
1919 (A) specific interventions, including mental
2020 health or behavioral supports;
2121 (B) academic support;
2222 (C) a conference with the student's parent or
2323 person standing in parental relation to the student;
2424 (D) a discipline referral; or
2525 (E) another restorative practice.
2626 (2) [(1)] "Harmful, threatening, or violent behavior"
2727 includes behaviors, such as verbal threats, threats of self harm,
2828 bullying, cyberbullying, fighting, the use or possession of a
2929 weapon, sexual assault, sexual harassment, dating violence,
3030 stalking, or assault, by a student that could result in:
3131 (A) specific interventions, including mental
3232 health or behavioral supports;
3333 (B) in-school suspension;
3434 (C) out-of-school suspension; or
3535 (D) the student's expulsion or removal to a
3636 disciplinary alternative education program or a juvenile justice
3737 alternative education program.
3838 (3) [(2)] "Team" means a threat assessment and safe
3939 and supportive school team established by the board of trustees of a
4040 school district under this section.
4141 (b) The agency, in coordination with the Texas School Safety
4242 Center, shall adopt rules to establish a safe and supportive school
4343 program. The rules shall incorporate research-based best practices
4444 for school safety, including providing for:
4545 (1) physical and psychological safety;
4646 (2) a multiphase and multihazard approach to
4747 prevention, mitigation, preparedness, response, and recovery in a
4848 crisis situation;
4949 (3) a systemic and coordinated multitiered support
5050 system that addresses school climate, the social and emotional
5151 domain, and behavioral and mental health; [and]
5252 (4) multidisciplinary and multiagency collaboration
5353 to assess risks and threats in schools and provide appropriate
5454 interventions, including rules for the establishment and operation
5555 of teams; and
5656 (5) a uniform method of identifying and collecting
5757 data regarding early behavior of a student that may require
5858 intervention.
5959 (f) Each team shall:
6060 (1) conduct a threat assessment that includes:
6161 (A) assessing and reporting individuals who make
6262 threats of violence or exhibit harmful, threatening, or violent
6363 behavior in accordance with the policies and procedures adopted
6464 under Subsection (c); and
6565 (B) gathering and analyzing data, including data
6666 regarding the early behavior of a student, to determine the level of
6767 risk and appropriate intervention, including:
6868 (i) referring a student for mental health
6969 assessment; and
7070 (ii) implementing an escalation procedure,
7171 if appropriate based on the team's assessment, in accordance with
7272 district policy;
7373 (2) provide guidance to students and school employees
7474 on recognizing harmful, threatening, or violent behavior that may
7575 pose a threat to the community, school, or individual; and
7676 (3) support the district in implementing the
7777 district's multihazard emergency operations plan.
7878 SECTION 2. This Act applies beginning with the 2023-2024
7979 school year.
8080 SECTION 3. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2023.
