55 relating to innovation grant programs to support residency training
66 programs in psychiatric specialty fields and recruitment,
77 training, and retention programs in behavioral health fields.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 58A, Education Code, is amended by
1010 adding Subchapter D to read as follows:
1111 SUBCHAPTER D. PSYCHIATRIC SPECIALTY INNOVATION GRANT PROGRAM
1212 Sec. 58A.071. PSYCHIATRIC SPECIALTY INNOVATION GRANT
1313 PROGRAM. Subject to available funds, the board shall establish an
1414 innovation grant program under which the board awards incentive
1515 payments to medical schools that administer innovative residency
1616 training programs designed to increase the number of physicians in
1717 this state who specialize in pediatric or adult psychiatric care.
1818 Sec. 58A.072. FEDERAL FUNDS AND GIFTS, GRANTS, AND
1919 DONATIONS. In addition to other money appropriated by the
2020 legislature, for the purpose of promoting pediatric or adult
2121 psychiatric care under the program established under this
2222 subchapter the board may:
2323 (1) seek and apply for any available federal funds;
2424 and
2525 (2) solicit and accept gifts, grants, and donations
2626 from any other source, public or private, as necessary to ensure
2727 effective implementation of the program.
2828 Sec. 58A.073. RULES. In consultation with each medical
2929 school in this state, the board shall adopt rules for the
3030 administration of the program established under this
3131 subchapter. The rules must include:
3232 (1) administrative provisions relating to the
3333 awarding of grants under this subchapter, such as:
3434 (A) eligibility criteria for medical schools,
3535 including a requirement that the medical school demonstrate
3636 regional and state workforce need;
3737 (B) grant application procedures;
3838 (C) guidelines relating to grant amounts;
3939 (D) procedures for evaluating grant
4040 applications; and
4141 (E) procedures for monitoring the use of grants;
4242 and
4343 (2) methods for tracking the effectiveness of grants
4444 that:
4545 (A) using data reasonably available to the board,
4646 consider relevant information regarding the career paths of medical
4747 school graduates during the four-year period following their
4848 graduation; and
4949 (B) evaluate whether and for how long those
5050 graduates practice in a psychiatric specialty field in this state.
5151 Sec. 58A.074. AWARD OF GRANTS. (a) In awarding grants
5252 under the program, the board shall award:
5353 (1) 60 percent of the amount available in each program
5454 year to medical schools with innovative residency programs that
5555 train physicians to specialize in pediatric psychiatric care; and
5656 (2) 40 percent of the amount available in each program
5757 year to medical schools with innovative residency programs that
5858 train physicians to specialize in adult psychiatric care.
5959 (b) Within each category of grants prescribed by Subsection
6060 (a), the board shall give priority to grants to medical schools with
6161 innovative residency programs based in rural or underserved areas.
6262 Sec. 58A.075. GRANT AMOUNT. The amount of a grant awarded
6363 under this subchapter may not exceed $1 million.
6464 Sec. 58A.076. REPORTING REQUIREMENTS. A medical school
6565 that receives a grant awarded under this subchapter shall submit to
6666 the board an annual report on the amounts and purposes for which
6767 grant funds were spent during the year covered by the report.
6868 Sec. 58A.077. ADMINISTRATIVE COSTS. A reasonable amount,
6969 not to exceed five percent, of any general revenue appropriated for
7070 purposes of this subchapter may be used by the board to pay the
7171 costs of administering this subchapter.
7272 SECTION 2. Chapter 61, Education Code, is amended by adding
7373 Subchapter RR to read as follows:
7474 SUBCHAPTER RR. BEHAVIORAL HEALTH INNOVATION GRANT PROGRAM
7575 Sec. 61.9991. BEHAVIORAL HEALTH INNOVATION GRANT PROGRAM.
7676 Subject to available funds, the board shall establish an innovation
7777 grant program under which the board awards incentive payments to
7878 institutions of higher education that administer innovative
7979 recruitment, training, and retention programs designed to increase
8080 the number of mental health professionals, as defined by Section
8181 61.601, or professionals in related fields, as determined by the
8282 board, including by providing a salary increase or stipend to a
8383 faculty member who provides instruction to additional students in a
8484 degree or certificate program that graduates those professionals.
8585 Sec. 61.9992. FEDERAL FUNDS AND GIFTS, GRANTS, AND
8686 DONATIONS. In addition to other money appropriated by the
8787 legislature, for the purpose of increasing the behavioral health
8888 workforce in this state under the program established under this
8989 subchapter the board may:
9090 (1) seek and apply for any available federal funds;
9191 and
9292 (2) solicit and accept gifts, grants, and donations
9393 from any other source, public or private, as necessary to ensure
9494 effective implementation of the program.
9595 Sec. 61.9993. RULES. (a) The board shall adopt rules for
9696 the administration of the program established under this
9797 subchapter. In adopting the rules, the board shall solicit from the
9898 Texas Behavioral Health Executive Council information necessary to
9999 identify programs anticipated to produce the best outcomes and
100100 serve the greatest need.
101101 (b) The rules must include:
102102 (1) administrative provisions relating to the
103103 awarding of grants under this subchapter, such as:
104104 (A) eligibility criteria for institutions of
105105 higher education, including a requirement that the institution
106106 demonstrate regional and state workforce need;
107107 (B) grant application procedures;
108108 (C) guidelines relating to grant amounts;
109109 (D) procedures for evaluating grant
110110 applications; and
111111 (E) procedures for monitoring the use of grants;
112112 and
113113 (2) methods for tracking the effectiveness of grants
114114 that:
115115 (A) using data reasonably available to the board,
116116 consider relevant information regarding the career paths of
117117 professionals described by Section 61.9991 during the four-year
118118 period following their graduation; and
119119 (B) evaluate whether and for how long those
120120 professionals practice in a field described by Section 61.9991 in
121121 this state.
122122 Sec. 61.9994. AWARD OF GRANTS. In awarding grants under the
123123 program, the board shall give priority to applicants that propose
124124 to:
125125 (1) enhance or leverage existing degree programs that
126126 graduate professionals described by Section 61.9991;
127127 (2) establish or maintain a program that serves a
128128 rural or underserved area;
129129 (3) partner with:
130130 (A) another institution of higher education to
131131 develop a joint program; or
132132 (B) a public school to implement early
133133 recruitment in high school;
134134 (4) establish or maintain a program that incentivizes
135135 professionals described by Section 61.9991 to serve in their field
136136 or a related field of study for at least three consecutive years
137137 following graduation in an inpatient or outpatient behavioral
138138 health facility or program that receives state funding;
139139 (5) establish or maintain a degree or certificate
140140 program to educate professionals in specialties that face
141141 significant workforce shortages, including those described by
142142 Section 61.601; or
143143 (6) establish or maintain psychiatric fellowship
144144 programs that serve correctional facilities or inpatient
145145 psychiatric facilities.
146146 Sec. 61.9995. GRANT AMOUNT. The amount of a grant awarded
147147 under this subchapter may not exceed $1 million.
148148 Sec. 61.9996. REPORTING REQUIREMENTS. An institution of
149149 higher education that receives a grant awarded under this
150150 subchapter shall submit to the board an annual report on the amounts
151151 and purposes for which grant funds were spent during the year
152152 covered by the report.
153153 Sec. 61.9997. ADMINISTRATIVE COSTS. A reasonable amount,
154154 not to exceed five percent, of any general revenue appropriated for
155155 purposes of this subchapter may be used by the board to pay the
156156 costs of administering this subchapter.
157157 SECTION 3. (a) As soon as practicable after the effective
158158 date of this Act, the Texas Higher Education Coordinating Board
159159 shall adopt rules for the implementation and administration of the
160160 innovation grant programs established under Subchapter D, Chapter
161161 58A, Education Code, and Subchapter RR, Chapter 61, Education Code,
162162 as added by this Act.
163163 (b) Not later than September 1, 2024, the Texas Higher
164164 Education Coordinating Board shall establish the innovation grant
165165 programs required by Subchapter D, Chapter 58A, Education Code, and
166166 Subchapter RR, Chapter 61, Education Code, as added by this Act, and
167167 shall begin to award grants under each program as soon as
168168 practicable after the program is established.
169169 SECTION 4. This Act takes effect September 1, 2023.
