---|
7 | 7 | | training, and retention programs in behavioral health fields. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Chapter 58A, Education Code, is amended by |
---|
10 | 10 | | adding Subchapter D to read as follows: |
---|
11 | 11 | | SUBCHAPTER D. PSYCHIATRIC SPECIALTY INNOVATION GRANT PROGRAM |
---|
12 | 12 | | Sec. 58A.071. PSYCHIATRIC SPECIALTY INNOVATION GRANT |
---|
13 | 13 | | PROGRAM. Subject to available funds, the board shall establish an |
---|
14 | 14 | | innovation grant program under which the board awards incentive |
---|
15 | 15 | | payments to medical schools that administer innovative residency |
---|
16 | 16 | | training programs designed to increase the number of physicians in |
---|
17 | 17 | | this state who specialize in pediatric or adult psychiatric care. |
---|
18 | 18 | | Sec. 58A.072. FEDERAL FUNDS AND GIFTS, GRANTS, AND |
---|
19 | 19 | | DONATIONS. In addition to other money appropriated by the |
---|
20 | 20 | | legislature, for the purpose of promoting pediatric or adult |
---|
21 | 21 | | psychiatric care under the program established under this |
---|
22 | 22 | | subchapter the board may: |
---|
23 | 23 | | (1) seek and apply for any available federal funds; |
---|
24 | 24 | | and |
---|
25 | 25 | | (2) solicit and accept gifts, grants, and donations |
---|
26 | 26 | | from any other source, public or private, as necessary to ensure |
---|
27 | 27 | | effective implementation of the program. |
---|
28 | 28 | | Sec. 58A.073. RULES. In consultation with each medical |
---|
29 | 29 | | school in this state, the board shall adopt rules for the |
---|
30 | 30 | | administration of the program established under this |
---|
31 | 31 | | subchapter. The rules must include: |
---|
32 | 32 | | (1) administrative provisions relating to the |
---|
33 | 33 | | awarding of grants under this subchapter, such as: |
---|
34 | 34 | | (A) eligibility criteria for medical schools, |
---|
35 | 35 | | including a requirement that the medical school demonstrate |
---|
36 | 36 | | regional and state workforce need; |
---|
37 | 37 | | (B) grant application procedures; |
---|
38 | 38 | | (C) guidelines relating to grant amounts; |
---|
39 | 39 | | (D) procedures for evaluating grant |
---|
40 | 40 | | applications; and |
---|
41 | 41 | | (E) procedures for monitoring the use of grants; |
---|
42 | 42 | | and |
---|
43 | 43 | | (2) methods for tracking the effectiveness of grants |
---|
44 | 44 | | that: |
---|
45 | 45 | | (A) using data reasonably available to the board, |
---|
46 | 46 | | consider relevant information regarding the career paths of medical |
---|
47 | 47 | | school graduates during the four-year period following their |
---|
48 | 48 | | graduation; and |
---|
49 | 49 | | (B) evaluate whether and for how long those |
---|
50 | 50 | | graduates practice in a psychiatric specialty field in this state. |
---|
51 | 51 | | Sec. 58A.074. AWARD OF GRANTS. (a) In awarding grants |
---|
52 | 52 | | under the program, the board shall award: |
---|
53 | 53 | | (1) 60 percent of the amount available in each program |
---|
54 | 54 | | year to medical schools with innovative residency programs that |
---|
55 | 55 | | train physicians to specialize in pediatric psychiatric care; and |
---|
56 | 56 | | (2) 40 percent of the amount available in each program |
---|
57 | 57 | | year to medical schools with innovative residency programs that |
---|
58 | 58 | | train physicians to specialize in adult psychiatric care. |
---|
59 | 59 | | (b) Within each category of grants prescribed by Subsection |
---|
60 | 60 | | (a), the board shall give priority to grants to medical schools with |
---|
61 | 61 | | innovative residency programs based in rural or underserved areas. |
---|
62 | 62 | | Sec. 58A.075. GRANT AMOUNT. The amount of a grant awarded |
---|
63 | 63 | | under this subchapter may not exceed $1 million. |
---|
64 | 64 | | Sec. 58A.076. REPORTING REQUIREMENTS. A medical school |
---|
65 | 65 | | that receives a grant awarded under this subchapter shall submit to |
---|
66 | 66 | | the board an annual report on the amounts and purposes for which |
---|
67 | 67 | | grant funds were spent during the year covered by the report. |
---|
68 | 68 | | Sec. 58A.077. ADMINISTRATIVE COSTS. A reasonable amount, |
---|
69 | 69 | | not to exceed five percent, of any general revenue appropriated for |
---|
70 | 70 | | purposes of this subchapter may be used by the board to pay the |
---|
71 | 71 | | costs of administering this subchapter. |
---|
72 | 72 | | SECTION 2. Chapter 61, Education Code, is amended by adding |
---|
73 | 73 | | Subchapter RR to read as follows: |

74 | 74 | | SUBCHAPTER RR. BEHAVIORAL HEALTH INNOVATION GRANT PROGRAM |

75 | 75 | | Sec. 61.9991. BEHAVIORAL HEALTH INNOVATION GRANT PROGRAM. |
---|
76 | 76 | | Subject to available funds, the board shall establish an innovation |
---|
77 | 77 | | grant program under which the board awards incentive payments to |
---|
78 | 78 | | institutions of higher education that administer innovative |
---|
79 | 79 | | recruitment, training, and retention programs designed to increase |
---|
80 | 80 | | the number of mental health professionals, as defined by Section |
---|
81 | 81 | | 61.601, or professionals in related fields, as determined by the |
---|
82 | 82 | | board, including by providing a salary increase or stipend to a |
---|
83 | 83 | | faculty member who provides instruction to additional students in a |
---|
84 | 84 | | degree or certificate program that graduates those professionals. |
---|
85 | 85 | | Sec. 61.9992. FEDERAL FUNDS AND GIFTS, GRANTS, AND |
---|
86 | 86 | | DONATIONS. In addition to other money appropriated by the |
---|
87 | 87 | | legislature, for the purpose of increasing the behavioral health |
---|
88 | 88 | | workforce in this state under the program established under this |
---|
89 | 89 | | subchapter the board may: |
---|
90 | 90 | | (1) seek and apply for any available federal funds; |
---|
91 | 91 | | and |
---|
92 | 92 | | (2) solicit and accept gifts, grants, and donations |
---|
93 | 93 | | from any other source, public or private, as necessary to ensure |
---|
94 | 94 | | effective implementation of the program. |
---|
95 | 95 | | Sec. 61.9993. RULES. (a) The board shall adopt rules for |
---|
96 | 96 | | the administration of the program established under this |
---|
97 | 97 | | subchapter. In adopting the rules, the board shall solicit from the |
---|
98 | 98 | | Texas Behavioral Health Executive Council information necessary to |
---|
99 | 99 | | identify programs anticipated to produce the best outcomes and |
---|
100 | 100 | | serve the greatest need. |
---|
101 | 101 | | (b) The rules must include: |
---|
102 | 102 | | (1) administrative provisions relating to the |
---|
103 | 103 | | awarding of grants under this subchapter, such as: |
---|
104 | 104 | | (A) eligibility criteria for institutions of |
---|
105 | 105 | | higher education, including a requirement that the institution |
---|
106 | 106 | | demonstrate regional and state workforce need; |
---|
107 | 107 | | (B) grant application procedures; |
---|
108 | 108 | | (C) guidelines relating to grant amounts; |
---|
109 | 109 | | (D) procedures for evaluating grant |
---|
110 | 110 | | applications; and |
---|
111 | 111 | | (E) procedures for monitoring the use of grants; |
---|
112 | 112 | | and |
---|
113 | 113 | | (2) methods for tracking the effectiveness of grants |
---|
114 | 114 | | that: |
---|
115 | 115 | | (A) using data reasonably available to the board, |
---|
116 | 116 | | consider relevant information regarding the career paths of |
---|
117 | 117 | | professionals described by Section 61.9991 during the four-year |
---|
118 | 118 | | period following their graduation; and |
---|
119 | 119 | | (B) evaluate whether and for how long those |
---|
120 | 120 | | professionals practice in a field described by Section 61.9991 in |
---|
121 | 121 | | this state. |
---|
122 | 122 | | Sec. 61.9994. AWARD OF GRANTS. In awarding grants under the |
---|
123 | 123 | | program, the board shall give priority to applicants that propose |
---|
124 | 124 | | to: |
---|
125 | 125 | | (1) enhance or leverage existing degree programs that |
---|
126 | 126 | | graduate professionals described by Section 61.9991; |
---|
127 | 127 | | (2) establish or maintain a program that serves a |
---|
128 | 128 | | rural or underserved area; |
---|
129 | 129 | | (3) partner with: |
---|
130 | 130 | | (A) another institution of higher education to |
---|
131 | 131 | | develop a joint program; or |
---|
132 | 132 | | (B) a public school to implement early |
---|
133 | 133 | | recruitment in high school; |
---|
134 | 134 | | (4) establish or maintain a program that incentivizes |
---|
135 | 135 | | professionals described by Section 61.9991 to serve in their field |
---|
136 | 136 | | or a related field of study for at least three consecutive years |
---|
137 | 137 | | following graduation in an inpatient or outpatient behavioral |
---|
138 | 138 | | health facility or program that receives state funding; |
---|
139 | 139 | | (5) establish or maintain a degree or certificate |
---|
140 | 140 | | program to educate professionals in specialties that face |
---|
141 | 141 | | significant workforce shortages, including those described by |
---|
142 | 142 | | Section 61.601; or |
---|
143 | 143 | | (6) establish or maintain psychiatric fellowship |
---|
144 | 144 | | programs that serve correctional facilities or inpatient |
---|
145 | 145 | | psychiatric facilities. |
---|
146 | 146 | | Sec. 61.9995. GRANT AMOUNT. The amount of a grant awarded |
---|
147 | 147 | | under this subchapter may not exceed $1 million. |
---|
148 | 148 | | Sec. 61.9996. REPORTING REQUIREMENTS. An institution of |
---|
149 | 149 | | higher education that receives a grant awarded under this |
---|
150 | 150 | | subchapter shall submit to the board an annual report on the amounts |
---|
151 | 151 | | and purposes for which grant funds were spent during the year |
---|
152 | 152 | | covered by the report. |
---|
153 | 153 | | Sec. 61.9997. ADMINISTRATIVE COSTS. A reasonable amount, |

158 | 158 | | date of this Act, the Texas Higher Education Coordinating Board |

159 | 159 | | shall adopt rules for the implementation and administration of the |
---|
160 | 160 | | innovation grant programs established under Subchapter D, Chapter |
---|
161 | 161 | | 58A, Education Code, and Subchapter RR, Chapter 61, Education Code, |
---|
162 | 162 | | as added by this Act. |
---|
163 | 163 | | (b) Not later than September 1, 2024, the Texas Higher |
---|
164 | 164 | | Education Coordinating Board shall establish the innovation grant |
---|
165 | 165 | | programs required by Subchapter D, Chapter 58A, Education Code, and |
---|
166 | 166 | | Subchapter RR, Chapter 61, Education Code, as added by this Act, and |
---|
167 | 167 | | shall begin to award grants under each program as soon as |
---|
168 | 168 | | practicable after the program is established. |
---|
169 | 169 | | SECTION 4. This Act takes effect September 1, 2023. |
---|
