55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the open carrying of a handgun by a uniformed school
88 marshal.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 37.0811(c) and (d), Education Code, are
1111 amended to read as follows:
1212 (c) A school marshal appointed by the board of trustees of a
1313 school district or the governing body of an open-enrollment charter
1414 school may carry [a concealed handgun] or possess a handgun on the
1515 physical premises of a school, but only:
1616 (1) in the manner provided by written regulations
1717 adopted by the board of trustees or the governing body; and
1818 (2) at a specific school as specified by the board of
1919 trustees or governing body, as applicable.
2020 (d) Any written regulations adopted for purposes of
2121 Subsection (c) must:
2222 (1) provide that a school marshal may:
2323 (A) carry a concealed handgun on the school
2424 marshal's person;
2525 (B) if wearing a uniform identifying the marshal
2626 as a school marshal, openly carry a handgun on the school marshal's
2727 person; or
2828 (C) possess the handgun on the physical premises
2929 of a school in a locked and secured safe or other locked and secured
3030 location; and
3131 (2) [. The written regulations must also] require
3232 that a handgun carried or possessed by a school marshal [may] be
3333 loaded only with frangible duty ammunition approved for that
3434 purpose by the Texas Commission on Law Enforcement.
3535 SECTION 2. Sections 37.0813(c) and (d), Education Code, are
3636 amended to read as follows:
3737 (c) A school marshal appointed by the governing body of a
3838 private school may carry [a concealed handgun] or possess a handgun
3939 on the physical premises of a school, but only in the manner
4040 provided by written regulations adopted by the governing body.
4141 (d) Any written regulations adopted for purposes of
4242 Subsection (c) must:
4343 (1) provide that a school marshal may:
4444 (A) carry a concealed handgun on the school
4545 marshal's person;
4646 (B) if wearing a uniform identifying the marshal
4747 as a school marshal, openly carry a handgun on the school marshal's
4848 person; or
4949 (C) possess the handgun on the physical premises
5050 of a school in a locked and secured safe or other locked and secured
5151 location; and
5252 (2) [. The written regulations must also] require
5353 that a handgun carried or possessed by a school marshal [may] be
5454 loaded only with frangible duty ammunition approved for that
5555 purpose by the Texas Commission on Law Enforcement.
5656 SECTION 3. Section 51.220(d), Education Code, is amended to
5757 read as follows:
5858 (d) A school marshal appointed by the governing board of a
5959 public junior college may carry [a concealed handgun] or possess a
6060 handgun on the physical premises of a public junior college campus,
6161 but only:
6262 (1) in the manner provided by written regulations
6363 adopted by the governing board; and
6464 (2) at a specific public junior college campus as
6565 specified by the governing board.
6666 SECTION 4. Section 51.220(e), Education Code, as amended by
6767 Chapters 795 (H.B. 781) and 851 (S.B. 741), Acts of the 87th
6868 Legislature, Regular Session, 2021, is reenacted and amended to
6969 read as follows:
7070 (e) Any written regulations adopted for purposes of
7171 Subsection (d):
7272 (1) must [:
7373 [(A)] authorize a school marshal to:
7474 (A) carry a concealed handgun [as described by
7575 Subsection (d)] on the school marshal's person;
7676 (B) if wearing a uniform identifying the marshal
7777 as a school marshal, openly carry a handgun on the school marshal's
7878 person; or
7979 (C) possess the handgun on the physical premises
8080 of a public junior college campus in a locked and secured safe or
8181 other locked and secured location; [and]
8282 (2) must [(B)] require that a handgun carried or
8383 possessed by a school marshal [to] be loaded only with frangible
8484 duty ammunition approved for that purpose by the Texas Commission
8585 on Law Enforcement; and
8686 (3) [(2)] may not require a school marshal to store
8787 the handgun in a locked container while on duty.
8888 SECTION 5. This Act applies beginning with the 2023-2024
8989 school year.
9090 SECTION 6. This Act takes effect immediately if it receives
9191 a vote of two-thirds of all the members elected to each house, as
9292 provided by Section 39, Article III, Texas Constitution. If this
9393 Act does not receive the vote necessary for immediate effect, this
9494 Act takes effect September 1, 2023.
