7 | 7 | | relating to the assessment on the gross receipts of electricity for |

8 | 8 | | certain providers of retail electric service. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Sections 16.001(a) and (b), Utilities Code, are |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (a) To pay [defray] the expenses incurred in the |
---|
13 | 13 | | administration of this title, an assessment is imposed on each |
---|
14 | 14 | | public utility, retail electric provider, and electric cooperative |
---|
15 | 15 | | within the jurisdiction of the commission that serves the ultimate |
---|
16 | 16 | | consumer, including each interexchange telecommunications carrier. |
---|
17 | 17 | | (b) An assessment under this section is equal to a |
---|
18 | 18 | | percentage [one-sixth of one percent] of the public utility's, |
---|
19 | 19 | | retail electric provider's, or electric cooperative's gross |
---|
20 | 20 | | receipts from rates charged to the ultimate consumer in this state |
---|
21 | 21 | | estimated by the commission to match the total amount of money |
---|
22 | 22 | | appropriated to the commission by the legislature to administer |
---|
23 | 23 | | this title for that state fiscal biennium. |
---|
24 | 24 | | SECTION 2. The change in law made by this Act does not |
---|
25 | 25 | | affect assessments due before the effective date of this Act, and |
---|
26 | 26 | | the law in effect before the effective date of this Act is continued |
---|
27 | 27 | | in effect for purposes of the liability for those assessments. |
---|
28 | 28 | | SECTION 3. This Act takes effect September 1, 2023. |
---|
