| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 111.101(e), Transportation Code, is |

| 9 | 9 | | amended to read as follows: |

| 10 | 10 | | (e) A fee collected under this section shall be deposited to |
|---|
| 11 | 11 | | the credit of the state highway fund and may be used only [general |
|---|
| 12 | 12 | | revenue fund to be used] for the rail safety program. |

| 13 | 13 | | SECTION 2. This Act takes effect September 1, 2023. |
