55 relating to the use of Parks and Wildlife Department land for carbon
66 sequestration or similar ecosystem services projects.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 11.032(b), Parks and Wildlife Code, is
99 amended to read as follows:
1010 (b) The department shall deposit to the credit of the game,
1111 fish, and water safety account all revenue, less allowable costs,
1212 from the following sources:
1313 (1) all types of fishing licenses and stamps and
1414 shrimping licenses;
1515 (2) all types of hunting licenses and stamps;
1616 (3) trapping licenses and other licenses relating to
1717 the taking, propagation, and sale of fur-bearing animals or their
1818 pelts;
1919 (4) sale of marl, sand, gravel, shell, and mudshell;
2020 (5) oyster bed rentals and permits;
2121 (6) federal funds received for fish and wildlife
2222 research, management, development and conservation, resource
2323 protection, and law enforcement, unless the funds are received for
2424 the specific purposes of Subchapter F, Chapter 77;
2525 (7) sale of property, less advertising costs,
2626 purchased from this account or a special fund or account that is now
2727 part of this account;
2828 (8) fines and penalties collected for violations of a
2929 law pertaining to the protection and conservation of wild birds,
3030 wild fowl, wild animals, fish, shrimp, oysters, game birds and
3131 animals, fur-bearing animals, alligators, and any other wildlife
3232 resources of this state;
3333 (9) sale of rough fish by the department;
3434 (10) fees for importation permits;
3535 (11) fees from supplying fish for or placing fish in
3636 water located on private property;
3737 (12) sale of seized pelts;
3838 (13) sale or lease of grazing rights to and the
3939 products from game preserves, sanctuaries, and management areas;
4040 (14) contracts for the removal of fur-bearing animals
4141 and reptiles from wildlife management areas;
4242 (15) vessel registration fees;
4343 (16) vessel manufacturer or dealer licensing fees;
4444 (17) fines or penalties imposed by a court for
4545 violation of water safety laws contained in Chapter 31 of this code;
4646 (18) alligator hunter's or alligator buyer's licenses;
4747 (19) sale of alligators or any part of an alligator by
4848 the department;
4949 (20) fees and revenue collected under Section
5050 11.027(b) or (c) of this code that are associated with the
5151 conservation of fish and wildlife;
5252 (21) fees related to cultivated oyster mariculture;
5353 (22) vessel and outboard motor titling fees;
5454 (23) participation fees collected under Section
5555 43.976; [and]
5656 (24) money received by the department from carbon
5757 sequestration or similar ecosystem services projects described by
5858 Section 11.302(b)(1); and
5959 (25) any other source provided by law.
6060 SECTION 2. Section 11.035(b), Parks and Wildlife Code, is
6161 amended to read as follows:
6262 (b) The department shall deposit to the credit of the state
6363 parks account all revenue, less allowable costs, received from the
6464 following sources:
6565 (1) grants or operation of concessions in state parks
6666 or fishing piers;
6767 (2) publications on state parks, state historic sites,
6868 or state scientific areas;
6969 (3) fines or penalties received from violations of
7070 regulations governing parks issued pursuant to Subchapter B,
7171 Chapter 13;
7272 (4) fees and revenue collected under Section 11.027(b)
7373 or (c) that are associated with state park lands;
7474 (5) credits made to the department under Section
7575 151.801, Tax Code, in an amount not to exceed the amount of the tax
7676 proceeds allocated by the legislature to the account under Section
7777 151.801(c-1), Tax Code, to be used only for the purposes provided by
7878 that section; [and]
7979 (6) money received by the department from carbon
8080 sequestration or similar ecosystem services projects described by
8181 Section 11.302(b)(2); and
8282 (7) any other source provided by law.
8383 SECTION 3. The heading to Subchapter L, Chapter 11, Parks
8484 and Wildlife Code, is amended to read as follows:
8585 SUBCHAPTER L. USE [GRANT OR LEASE] OF DEPARTMENT LAND
8686 SECTION 4. Subchapter L, Chapter 11, Parks and Wildlife
8787 Code, is amended by adding Section 11.302 to read as follows:
8888 Sec. 11.302. CARBON SEQUESTRATION AND SIMILAR ECOSYSTEM
8989 SERVICES PROJECTS. (a) Except as otherwise provided by this
9090 subsection, the department may enter into an agreement with a
9191 public or private entity for the purpose of developing a
9292 nature-based carbon sequestration or similar ecosystem services
9393 project on department land. This subsection does not authorize the
9494 department to enter into an agreement to develop a carbon dioxide
9595 injection well on department land.
9696 (b) Money received by the department from a carbon
9797 sequestration or similar ecosystem services project under this
9898 section shall be deposited:
9999 (1) to the credit of the game, fish, and water safety
100100 account, if the project is located on land primarily used for game
101101 or fish conservation, protection, or management; and
102102 (2) to the credit of the state parks account, if the
103103 project is located on land primarily used for parks, recreation, or
104104 historic sites.
105105 SECTION 5. This Act takes effect September 1, 2023.
