55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to excused absences from public school for students with a
88 menstrual disorder.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.087, Education Code, is amended by
1111 adding Subsection (b-10) and amending Subsection (d) to read as
1212 follows:
1313 (b-10) A school district shall excuse a student from
1414 attending school for a maximum of 10 days in a school year for an
1515 absence resulting from symptoms related to a menstrual disorder,
1616 such as dysmenorrhea, endometriosis, menorrhagia, or polycystic
1717 ovary syndrome, if the student or the student's parent or guardian
1818 provides documentation from a physician licensed to practice
1919 medicine in this state stating that the student has a menstrual
2020 disorder.
2121 (d) A student whose absence is excused under Subsection (b),
2222 (b-1), (b-2), (b-4), (b-5), (b-7), (b-10), or (c) may not be
2323 penalized for that absence and shall be counted as if the student
2424 attended school for purposes of calculating the average daily
2525 attendance of students in the school district. A student whose
2626 absence is excused under Subsection (b), (b-1), (b-2), (b-4),
2727 (b-5), (b-7), (b-10), or (c) shall be allowed a reasonable time to
2828 make up school work missed on those days. If the student
2929 satisfactorily completes the school work, the day of absence shall
3030 be counted as a day of compulsory attendance.
3131 SECTION 2. This Act applies beginning with the 2023-2024
3232 school year.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2023.
